238 about his Suit in that part apposed to One thousand two hundred and seven pounds of tobacco and not more and because the aforesaid John Deny's not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid John Purnall Recover against the Said Benjamin Sharpe his damages aforesaid to the aforesaid One thousand two hundred and Seven pounds of tobacco by the Same Benjamin sharpe in form aforesaid Confessed as also three hundred & One 301 pounds of tobacco for his Costs and Charges aforesaid to the Same John at his request by the Court here and Consent of the parties aforesaid adjudged &c and the aforesaid deft in Mercy &c
And whereupon the same Caleb by Francis Allen his attorney Complaines that whereas the said Caleb the first day of October Anno Dom Seventeen hundred and thirty One at the County afd of Somerset aforesaid within the Jurisdiction of this Court was possessed with one barron Cow of the price of Forty Shillings Currant money of Maryland as of his Own proper Cow and being so thereof possessed the said cow out of his hands and possession causually Lost which said Cow afterwards to witt the day and year aforesaid at the place aforesaid in the County aforesaid to the hands and possession of the aforesaid Patrick by finding Came Nevertheless the Said Patrick Knowing the Cow aforesaid to be the proper cow of him the said Caleb and to him the Said Caleb of right to belong and appertaine but plotting and fraudulently Intending the Said Caleb in that part Craftilly and Subtilly to deceive and defraud the aforesaid cow to the Said Caleb tho' often thereunto requested by the said Caleb hath not delivered but the Cow aforesaid afterwards to witt the first day of November in the Year aforesaid at the County aforesaid to his Own proper Use did Convert and dispose to the damage of the Said Caleb of four pounds Curr money afd and thereupon he brings suite &c pledges &c Jno Doe & R Roe And the aforesaid Patrick Daley by George Dashiell his attorney Came & defended the force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the Same day is Given to the aforesaid Caleb here also &c Att which said next Court to witt the twentyeth day of June ^anno Dom One thousand seven hundred & thirty two^ Came againe as well the aforesaid Caleb Harris as the aforesaid Patrick Daley by their attorneys afd and whereupon the Said Patrick prays further Leave thereof to Imparle here untill the Next Court and he hath it and the Same day is Given to the aforesaid Caleb here also &c Att which said next Court to witt the fifteenth day August Anno |
