237 fourth day of august in the year aforesaid and Often afterwards at Somerset County aforesaid within the Jurisdiction aforesaid he was thereunto requested hath not paid or to him for the Same in any Sort Contented but the Same to him hitherto to pay or in any sort to Content hath refused and still doth refuse and deny whereupon he Saith that he is worse and hath damage to the value of twenty pounds Like money and thereupon he brings Suit &c pledges &c Jno Doe & R Roe And the aforesaid Thomas Caldwell by George Dashiell his attorney Cometh and defendeth the force and Injury when &c and prays Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the aforesaid plft here also &c Att which said next Court to witt the twentieth day of June Anno Dom One thousand seven hundred and thirty two Came againe as well the aforesaid Sarah Prittiman as the aforesaid Thomas Caldwell by their attorneys aforesaid and thereupon the Said Thomas Caldwell prays further Leave ^thereof^ to Imparle here untill next court and he hath it and the Same day is Given to the aforesaid Sarah here also &c Att which said next Court to witt the fifteenth day of august anno Dom One thousand seven hundred and thirty two Came againe as well the aforesaid Sarah Prittiman as the aforesaid Thomas Caldwell by their attorneys aforesaid and whereupon the said Thomas as before defends the force and Injury when &c and Says that he Cannot Gainsay the action aforesaid of the aforesaid Sarah nor but that he did assume upon himselfe in manner and form as the aforesaid Sarah above against him Complained and as to the damage of the Same Sarah by her by occasion of the premisses in that part Sustained the Same Thomas Says and Confesseth that the aforesaid Sarah has Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his suit in that part apposed to ten pounds Curr money of america and not more and because the aforesaid Sarah denys not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the parties ^afd^ it is Considered that the afd Sarah Prittiman Recover against the aforesaid Thomas Caldwell her damages aforesaid to the aforesaid ten pounds Currant money of america by the Same Thomas in manner and form aforesaid Confessed as also Two hundred 233 and thirty three pounds of tobacco for her Costs and Charges aforesaid to the Same Sarah at her request by the Court here and Consent of the parties aforesaid adjudged &c & ye afd deft in mercy &c
