236 to the Said John Marrey the aforesd Quantity or two Casks of Cyder Containing one hundred and twenty five Gallons or hath Otherwise Satisfied the Said John Murrey for the Same that upon a full hearing of the Cause Your Worships may proceed to Make Such decree in the premisses for your petitioners relief as Shall be agreable to Equity and a good Conscience and Your Petitioner as in Duty bound Shall always pray &c And the aforesaid John Harper by Levin Gale his attorney Comes and prays Leave to Imparle to the petition aforesaid and he hath it and the Same day is Given to the afd Jno Murray here also &c Att which Said Next Court to witt the twentieth day of June anno Dom One thousand Seven Hundred and thirty two Came againe as well the aforesaid John Murray as the aforesaid John Harper by their attorneys aforesaid and thereupon the Said John Harper prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the aforesaid John Murray here also &c Att which Said Next Court to witt the fifteenth day of August Anno Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid John Murray as the aforesaid John Harper by their attorneys aforesaid And whereupon all and Singular the premisses by the Court here being seen heard and fully understood and mature deliberation thereupon had as well on the part of the Said John Murray as on the part of the said John Harper and what was delivered upon Oath in relation to the premisses afd Wherefore it is Considered by the Court that the afd former Judgmt be Confirmed and that the said John Murray take nothing by his petition afd &c and further it is Considered that the aforesaid John Harper recover against the aforesaid Murray 168 One hundred and Sixty Eight pounds of tobacco for his Costs and Charges by him about his defence in that part apposed according to act of assembly in Such Case made and provided &c
the fourth day of August Anno Dom One thousand Seven hundred and twenty four at Somerset County within the Jurisdiction of this Court was indebted unto the said Sarah in ten pounds Currant money of america as by a Certain not hereunto annexed may in court appear and being so thereof indebted the said Thomas in consideration thereof the day and year aforesaid at Somerset County aforesaid within the Jurisdiction aforesaid upon himselfe did assume and to the Said Sarah then and there did faithfully promise that he the said Thomas the said ten pounds Currant money of america to the Said Sarah when he should be thereunto requested he would well and faithfully pay and Content nevertheless the Said Thomas his promise and assumption aforesaid in form aforesaid made nothing regarding but plotting and fraudulently Intending the Said Sarah in that part craftilly and Subtilly to deceive and defraud the aforesaid ten pounds to the said Sarah altho' the Same to do the Said Thomas by the aforesaid Sarah on the aforesd fourth |
