237 his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November Next to answer unto John Purnall of a plea of trespass upon the Case &c and that thereof he should not fail &c Att which Said third tuesday of November to witt the Sixteenth day of the Same month anno Dom One thousand Seven hundred and thirty One Came the said John Purnall by Francis Allen his attorney and the sher of Somerset County to whom the foregoeing writt was directed Likewise Came and made return thereof to the Court here Endorsed in these words following Cepi Corpus P Joshua Caldwell sher Whereupon the Said Benjamin sharpe being Called appears and thereupon the Said Benjamin sharpe at the prayer of the afd John Purnall by his attorney aforesaid p is adjudged to Give speciall bail to the action aforesaid but for want thereof the Said Benjamin sharpe is Committed into the Custody of the sher of Somerset County thereto remain &c the Said sher to witt Joshua Caldwell Gent present here in Court took Charge of ye Said Benj.a sharpe accordingly thereupon day is Given by the Court hereunto the said Benj.a Sharpe in Custody as aforesaid untill next Court and the Same day is Given to the afd John Purnall there also Att which said next Court to witt the twenty first day of March anno Dom One thousand seven hundred and thirty One Came againe as well the afd John Purnall by his attorney aforesaid as the said Benja Sharpe in Custody as aforesaid and thereupon further day is Given to the said Benjamin in Custody as afd untill next Court and the Same day is given to the aforesaid John here also Att which Said next Court to witt the twentieth day of June Anno Dom One thousand Seven hundred & thirty two Came againe as well the aforesaid John Purnall by his attorney ^afd^ as the said Benja sharpe in Custody as aforesaid and the Said John Purnall by his said attorney Complained against the said Benja in Custody as afd in the plea afd as followeth viz.t Somerset ss Benjamin Sharp Late of Somerset County Shipwright was attached to answer unto Jno Purnall of a plea of trespass upon the Case &c And whereupon the Said John by Francis Allen his attorney Complaines that whereas the Said Benj.a the first day of december anno Dom One thousand Seven hundred and thirty at Somerset County within the Jurisdiction of this Court was indebted unto the Said John in One thousand two hundred and Seventy pounds of for so much by the said John for the Said Benj.a to Sundry persons to and for the use of the Said Benj.a before that time deposited and paid as by an acco.t hereunto annxeted may in Court appear and being so thereof indebted the Said Benjamin in Consideration thereof the day and year aforesaid at Somerset County aforesaid within the Jurisdiction aforesaid upon himselfe did assume and to the said John then and there did faithfully promise that he the Said Benjamin the said One thousand two hundred and Seventy pounds of tobacco to the said John when he should be afterwards thereunto Requested he would well and faithfully pay and Content Nevertheless the Said Benj.a his promise & assumption aforesaid in form aforesaid made nothing regarding but plotting and fraudulently Intending the Said John in that part Craftilly and Subtilly to deceive and defraud the afd One thousand |
