234 said Luke Bowen above against him hath Complained and of this he puts himselfe upon the Country and the aforesaid plft Likewise Thereupon Command was given to the sher of Somerset County that Immediately he he should Cause to Come here twelve &c by whom &c and who neither &c to recognize &c because as well &c of which said preceipt the Said sher to witt Joshua Caldwell Gent now hereat this day to witt the same day & Year Last mentioned comes and makes Return that he hath here ready twelve &c as by his said preceipt he was commanded and now hereafterwards to witt the same day and year Came as well the afd plft as the afd deft by their attorneys aforesaid and the Jurors of that Jury therein Impannelled being Called Came to witt William Jones, Charles Racklife, Moses Duskey, John Tull, Thomas Hearn, Isaac Marshall, Joseph Waite, John Owten, Benja Tull, William Smith Geo Maglamory and Richard Holland who to say the truth of the premisses being duely elected tryed and sworn Upon their Oath did say that the Said Robert Bevill did assume upon himselfe in manner and form as the said Luke Bowen above against him hath Complained and assesed the damage of the Same Luke by Occasion of the non performance of the promise and assumption aforesaid beyound his Costs and Charges in that part apposed to two pounds eight shillings and nine pence Curr money and for those Costs and Charges to one pound of tobacco Therefore it is Considered that the aforesaid Luke Bowen recover against the aforesaid Robert Bevill his damages aforesaid by the Jurors aforesaid in form aforesaid assessed as also Six hundred & twenty 628 Eight pounds of tobacco for his Costs and Charges aforesaid to the Same Luke by the Court here of his assent of Increase adjudged which Certain damages in the whole do amount to two pounds Eight shillings and nine pence Currant money and pounds of tobacco and the aforesaid Robert in mercy &c
owes and Unjustly Detains &c And Whereupon the Said Joseph by Francis Allen his Attorney Saith that Whereas the Said William the Eleventh day of ferbery one thousand Seven Hundred and thirty thirty one at Somrset County aforesd within the Jurisdiction of this Court by his Certain Writing Obligatory which the Said Joseph with the Seal of the Said William Signed herein Court brings the date whereof is the Same Day and Year did acknowledge himselfe to be bound unto the Said Joseph in the aforesd one hundred pounds to be paid unto the Said Joseph when he Should be thereunto required yett the Said William tho' often required the Said one hundred pounds to the Said Joseph hath not rendered but the Same to him hitherto to render hath Denyed and Still doth Deny and Unjustly Detain to the Damage of |
