233 that Immediately they should Cause to Come here twelve &c by whom &c and who neither &c to recognize &c because as well &c and afterwards in the Same Court Came the Said Coroners to witt Henry Ballard and Will.m Lans Gent.m and made return that they had there ready twelve &c as aforesaid they were Commanded and the Jurors of that Same Jury by the afd Coroners to this being Impannelled being Called Came to witt Edward Beachamp Isaac Marshall, Moses Duskey, Charles Rankliffe, Wm Smith, William Polk, Richard Holland Robert Mitchell, William Gray Dennis Duskey Joseph Waite and Benjamin Tull who to say the truth in the premisses being duely elected tryed and Sworn upon their Oath did Say that the aforesaid Joshua Caldwell John Dennis and Isaac Fleming nor neither of them are Guilty of the trespass afd in manner and form as the aforesaid Henry Fitzwaters above against them hath Complained &c Therefore it is Considered that the aforesaid Henry Fitzwaters take nothing by his declaration aforesaid but be in mercy for his falce Clamour and that the aforesaid Joshua Caldwell John Dennis and Isaac Fleming go thereof without day &c Likewise it is Considered by the Justices here that the aforesaid Joshua Caldwell John Dennis and Isaac Fleming recover against the afd Henry Fitzwaters Seven hundred & Ninty Seven 794 pounds of tobacco for their Costs and Charges by them about their defence in that part Sustained to the Same Joshua, John and Isaac by the Court here according to the form of the Statute in such Case made and provided adjudged and that the afd Joshua, Jn.o & Isaac have thereof Execution &c
County aforesaid and within the Jurisdiction of this Court was Indebted unto the Same Luke in four pounds and three pence currant money of Maryland the same being for six months diet and Lodging beginning October Fifteenth Anno Dom One thousand seven hundred and thirty and ending Aprill the Fifteenth Anno Dom One thousand seven hundred and thirty One at and after the rate of One hundred pence p month as also for sixty four pounds of Porke at two pence p pound fifteen cuts of white oak timber at One shilling and three pence p Cutt and Seventy hoop poles at One penny p pole amounting in the whole to the aforesaid Sum of four pounds and three pence Currant Money as aforesaid as by an account therof hereunto annexed may in court appear and being so thereof Indebted the said Robert afterwards to witt the aforesaid fifteenth day of aprill in the year aforesaid at Somerset Coty aforesaid and within the Jurisdiction aforesaid in Consideration thereof upon himselfe did assume and to the said Luke then and there did faithfully promise that he ye Said Robert the aforesaid four pounds and three pence money aforesaid to the Said Luke when he should be thereunto requested well and faithfull would pay and Content and altho' the said Robert One pound two shillings and four pence pcell of the aforesaid four pounds and three pence to the Said Luke he hath Since paid and satisfied Yett as to two pounds seventeen shillings and eleven pence residue of the aforesaid four pounds and |
