233 Whereupon all and Singular the premisses by the Court here being seen heard and fully understood and mature deliberation thereupon had wherefore it seemeth to the Justices here that the aforesaid William Fasit hath not any right or property in the aforesaid Steers &c Therefore it is Considered that the aforesaid William Fasit take nothing by his declaration afd but be in mercy for his falce Clamour and that the aforesaid John Holland goe thereof without day &c and Likewise it is Considered by the Justices here that the aforesaid John Holland recover against the 1357 aforesaid William Fasit thirteen hundred & fifty Seven pound of tobacco for his Costs and Charges by him about his defence in that part sustained to the same John Holland by the Court here adjudged according to the form of the Statute in Such case Lately made and provided and that ye afd Jno have thereof execution &c
And whereupon the said Henry by Thomas Bluet his attorney Complaines that the said John and Isaac the first day of January in the Year of Our Lord one thousand Seven hundred and thirty one at Somerset County aforesd and within the Jur of this Court found and without reasonable Ca^u^se took and Impounded three Mares the goods and Chattells of him the Said Henry and them in the Said Pound so Long detained that the Said Mares were much the Worse and other Enormities to him ofered to the damage of him the said Henry ten pounds Current Money and against the Peace of the right Honrble the Lord proprietary &c And thence he bringeth Suit &c Pledges p.r Jno Doe R Roe And the aforesaid Joshua Caldwell, John Dennis and Isaac Fleming by Francis Allen their attorney Came and defended the force and Injury when &c and pray Leave thereof to Imparle hereunto untill next Court and they have it and the Same day is Given to the aforesaid Henry Fitzwaters here also &c Att which said next Court to witt the fifteenth day of Augus.t anno Dom One thousand seven hundred and thirty two came againe as well the aforesaid Henry Fitzwaters as the aforesaid Joshua Caldwell, John Dennis and Isaac Fleming by their attorneys aforesaid and thereupon the said Joshua, John and Isaac as before defends the force and Jury when &c and say that they of the trespass aforesaid above upon them Imposed are not Guilty in manner and form as the said Henry above against them hath Complained and of this they put themselves upon the County and the plft in Like manner &c Thereupon command was Given to the Coroners of Somerset County that |
