230 by Levin Gale his attorney and the sher of Somerset County to witt Joshua Caldwell Gent at the Same day returned that he by Vertue of the writt aforesaid to him directed he had made known unto the aforesaid John Benston by Littleton Townsend and Thomas Tull honest and Lawfull men of his Bayliwick that he be and appear before his Lordships Justices at the day and place aforesaid to shew &c as to him it was Commanded and the aforesaid John Benston so fore warned at the Same day being Solemnly Called Came not but made default &c Therefore it is Considered that the aforesaid Lewis Jenkins have his Execution against the aforesaid John Benston of the damages aforesaid &c
Thomas Bluett of a plea of trespass upon the case &c and that thereof he should not fail &c And the said Thomas Bluett in his Own proper person Complaineth against the Said James Emra in the plea aforesaid as followeth &c Somerset ss James Emra late of Somerset County Merchant was attached to answer unto Thomas Bluet of a plea of trespass upon the Case &c And whereupon the Same Thomas Bluett in his Own proper person Complaines that whereas the aforesd James the tenth Day of March Ann Dom one thousand Seven hundred and twenty Seven Eight at Somerset County within the Jurisdiction of this Court was Indebted unto the Same Thomas in two pounds twelve Shillings Current money of american and so thereof being the Said James afterwards to witt the Same day and year aforesd at the County aforesd and with in the aforesd Jur in Consideration thereof upon himself Assumed and to the Said Thomas then and there faithfully did promise that he when afterwards he Should be thereto requested he the aforesd Sum of two pounds twelve Shillings to the Same Thomas well and faithfully would Content and pay Nevertheless the Said James in that part Craftilly and Subtilly to Defraud and Deceive he the Said James the aforesaid Sum of two pounds twelve Shillings or any part thereof to the Same Thomas hath ^not^ paid or him for it in any wise Contented altho the Said James the Same to do afterwards to wit the Same Day and year aforesd at the County aforesd and within the afd Jurisdiction was requested but the Same James the Same to do hitherto hath refused and Still doth refuse Where by the Same Thomas Saith he is Worse and hath Damage to the Value of five pounds two Shillings Like Money and thereof brings this Suit &c L Gale p Qur Pledges Jno Doe R Roe Mr James |
