228 at dividing Creek the third tuesday of August then next to answer unto Ephraim Wilson of a plea of trespass upon the Case &c and that thereof he should not fail &c Somerset ss Nathaniel Foche, James Peirce and John Wood administrators of Hugh Arbuth not Late of London merchant dec.d were attached to answer unto Ephraim Wilson of a plea of trespass upon the case &c And whereupon the Said Ephraim by Levin Gale his Attorney Complaines that whereas the Said Hugh Arbuth not in his Life time to the afd Ephraim Willson to witt the thirtieth day of August Ann Dom one thousand Seven hundred and thirty one at Somerset County within the Jurisdiction of this Court Accounted of Divers Sums of Money to the Said Ephraim by the Said Hugh in his Life time before then Due and Remaining behind unpaid and upon the Said accounting the Said Hugh then and there being found in Arrears to the Said Ephraim in the Sum of twelve pounds three Shillings and five pence Sterling Money money of Great Brittaine and the Said Hugh in his Life time in Consideration thereof upon himselfe Did Assume and to the Said Ephraim Willson then and there faithfully promised that he the Said Hugh the Said twelve pounds three Shillings and five pence Sterling Money to the Said Ephraim well and faithfully would pay and Content When Afterwards he Should be thereunto required Nevertheless the Said Hugh in his Life and the Said Nath.l Foche James Peirce and John Wood after the Death of the Said Hugh the Promise and Assumption of the Said Hugh so as afd in his Life time made no ways regarding but Designing and fraudulently intending him the Said Ephraim to Deceive and Defraud the Said twelve pounds three Shillings and five pence Sterling or any part thereof to the Said Ephraim hath not paid or Satisfied Altho this to do the Said Hugh in his LIfe time and the Said Nathaniel James and John since the Death of the Said Hugh by the Said Ephraim to witt the first Day of Septemb.r in the Year afd at Somerset County afd Within the Jur was required but the Same to the Said Ephraim to pay the Said Hugh in his Life and the aforesd Nathaniel, James and John since his Death have altogether refused and Still doth refuse to the Damage of the Said Ephraim of twenty four pounds Six Shillings and tenn pence ster and thence Brings Suit &c pledges &c Jno Doe & R Roe Att which said third tuesday of August to witt the fifteenth day of the Same month being the day of the Return of the Said Writt anno Dom One thousand seven hundred and thirty two being the day of the return of the Said Writt Cometh the Said Ephraim Wilson by his attorney aforesaid & the sher of Somerset County to whom the foregoing writt was directed comes and makes return thereof to the Court here Endorsed as followeth viz.t Non est Inventus short note Left p Joshua Caldwell sher whereupon |
