of the ^return of the^ Said Writt Cometh the Said John Stewart by his attorney aforesaid and the Sher of Somerset County to
whom the foregoeing writt was directed Comes and makes Return thereof to the Court here Endorsed in these
words following vizt Cepi Corpus declaration delivered in time  P Joshua Caldwell sher

             Whereupon the said Aristobulus Christopher present herein Court in his proper person at the
prayer of the aforesaid John Stewart by his attorney is adjudged to Give Special bail to the action
aforesaid thereupon Heber Whittingham of Somerset County Gent present here in Court assumed upon
himselfe and undertook for the Said Aristobulus Christopher that if in Case the Said John Stewart
should recover Judgm.t in the plea aforesaid against the Said Aristobulus or that the Said Aristobulus should be
therein Convict that then he the Said Aristobulus shall pay the Condemnation of the Court thereupon or
Render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that he the said
Heber Whittingham will do the Same for him

And the Said Aristobulus Christopher by Robert Jenckins Henry his attorney Comes and defends the force
and Injury when &c and Saith that he Cannot Gainsay the action the action aforesaid of the aforesaid
John nor but that he the Same Aristobulus did assume upon himselfe in manner and form as the aforesaid
John above against him Complained and as to the damage of the Same John by him by occasion of the
premisses in that part Sustained the Same Aristobulus saith and Confesseth that the aforesaid John has
Sustained damages by Occasion of the premisses beyound his Costs and Charges in that part apposed
to Seventeen pounds Seventeen shillings and four pence Currant Money and not more and because the
aforesaid John deny's not this but the Same Allegation Confesseth to be true prays Judgmt and those
damages above Confessed together with his Costs and Charges aforesaid to him adjduged &c

          Therefore by Consent of the parties aforesaid it is Considered that the aforesaid John Stewart
Recover against the aforesaid Aristobulus Christopher his damages aforesaid to the aforesaid Seventeen
pounds Seventeen shillings and four pence Currant money by the Same Aristobulus in form aforesaid
Confessed as also four hundred and Seventy                                    pounds of tobacco for his Costs &
Charges aforesaid to the Same John at his request by the Court now here and Consent of the parties afd
adjudged which Certain damages in the whole do amount to Seventeen pounds Seventeen shillings and
four pence Cur money and four hundred & Seventy                                 pounds of tobacco and the
aforesaid deft in Mercy &c
