227 same in such Order as he was Oblidged to by a former agreement with the Court in that Case made & they to make their report to next Court Att which Said Next Court to witt the fifteenth day of august anno Dom One thousand Seven hundred and thirty two Came hereinto Court as well the afd John Dennis as the afd James Martin and William Lane the Gent who were appointed by the Court to View and Inspect the Said Mill dam and gates and reported to this Court that the aforesaid Mill dam and Gates were passable and in Good repair according to the aforesaid former Contract &c Wherefore it is Considered that the afd presentment be quashed and that ye said John Dennis be thereof Quiet and goe thereof without day &c
August then next to answer unto John Stewart of a plea of trespass upon the case &c and that thereof he should not fail &c And the aforesaid John Stewart by Francis Allen his attorney Complaines against the said Aristobulus Christopher in the plea aforesaid as followeth vizt Somerset County ss Aristobulus Christopher late of somerset County shipwright was attached to answer unto John Stewart of a plea of trespass upon the Case &c And whereupon the said John by Francis Allen his attorney complaines that whereas the said Aristobulus the third day of Novem Ann.o Dom One thousand seven hundred and thirty at somerset County aforesaid within the Jurisdiction of this Court had accounted together with the Said John of Sundry Sums of money by the said Aristobulus to the Said John before that time due Owing and unpaid and upon that account the said Aristobulus then and there was found in Arrears to the Said John the full and Just Sum of Seventeen pounds Seventeen shillings and four pence Currant Money aforesaid and being so found in arrears the Said Aristobulus then and there did faithfully promise that the Said Aristobulus the Said Seventeen pounds Seventeen shillings and four pence to the Said John When he should be thereunto requested he would well and faithfully pay and Content Nevertheless the Said Aristobulus his promise and assumption aforesaid in form aforesaid made nothing regarding but plotting and fraudulently Intending the Said John in that part Craftilly and Subtilly to deceive and defrand the Said Seventeen pounds Seventeen shillings and four pence to the Said John altho' the Same to do the Said Aristobulus by the Said John on the aforesaid third day of Novem in the year aforesaid and often afterwards at the County aforesaid within the Jurisdiction aforesaid he was thereunto Requested hath not paid or Contented but the Same to him hither to pay or Content hath refused and Still doth refuse and deny to the damage of the said John of thirty pounds Curr money of Maryland and thereupon he brings Suite F Allen P Qur Pledges &c Jno Doe R Roe A Copy of the foregeoing declaration was made and Sent to be Served on the deft (according to Law) with the writt aforesaid Att which said third tuesday of August to witt the fifteenth day of the Same month anno Dom One thousand seven hundred and thirty two being the day of return of |
