before his Justices of our ^his Lordships^ County Court of Somerset to be held at Dividing Creek the third tuesday of Novemb.r then Next to answere unto Thomas Selby of a plea of trespass upon the Case and that thereof he Should not fail &c Att which said third tuesday of Novemb.r to witt the Sixteenth day of the Same Ann Dom one thousand Seven hundred and thirty one being the day of the Returne of the Said Writt Cometh the afd Thomas Selby by Will.m Beckingham his attorney and the Sher of Somerset County to whom the foregoing writt was Directed ^Likewise^ Comes and makes returne thereof to the Court here Endorsed Vizt Cepi Corpus p Joshua Caldwell sher And the Said Benjamin Houston by fran Allen his attorney Comes & defends the force and Injury when &c and prays Leave thereof to Imparle here untill next Court & he hath it & ye same day is Given to the aforesaid Thomas here also &c Att which said next Court to witt the twenty first day of March ann Dom one thousand Seven hundred and thirty one Came again as well the aforesd Tho.s Selby as the aforesd Benj.a Houston by their Attorneys aforesd and ^whereupon^ the afd Benj.a prays further Leave thereof to Imparle here untill the Next Court and he hath it and the Same day is given unto the afd Thom.s here also &c Att which said next Court to witt the twentieth day of June anno Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid thirty two Came againe as well the aforesaid Thomas Selby as the aforesaid Benjamin Houston by their attorneys aforesaid and whereupon the aforesaid Thomas Selby who offered the writt aforesaid against the aforesaid Benjamin Howston late of somerset County planter in the afd plea of trespass upon the Case &c did not prosecute his writt aforesaid Therefore he and his pledges of prosecuting be in mercy and the plft nominate pledges &c And that the aforesaid Benj.a go thereof without day It is Considered also that Benjamin ^Houston^ Recover against the aforesaid Thomas ^Selby^ his damages by Occasion of the premisses afd to 165 pounds of tobacco to the Same Benj.a by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute &c by the Court here adjudged &c
Court of Somerset at dividing Creek Recovered against him as of three hundred and twenty eight pounds of tobacco which to the Same John Atkinson in the Same Court were adjudged for his damages which he had by occasion of the detention of that same debt and the Same Pork and tobacco the Same sher should have before the Justices |
