215 Stewart and the Said James Shirley ought not because he saith that after the twenty first day of March Last past from which Said Day the Cause aforesd between the parties aforesd was Continued and before this day (to witt) the twentyeth day of June in the year of our Lord Seventeen hundred and thirty two (to witt) the first day of June in the year Last mentioned at Somerset County did pay and Satisfie unto the aforesd John Stewart the one thousands pounds of tobacco in the Condition and this he is ready to Veryfie he prays Judgm.t and that the Justices hereof and upon the premises to proceed further will not Whereupon the aforesaid James Shirley Relinquisheth his Verification aforesaid by him above pretended and Says that he Cannot Gainsay the action aforesaid of the aforesaid John Stewart nor Can he Say but that the writing Obligatory aforesaid is the deed of him the Same James nor but that he Owes the Same John the aforesaid two thousand pounds of tobacco in manner and form as the aforesaid John above against him declared &c Therefore it is Considered that the aforesaid John Stewart recover against the afd James Shirley his debt aforesaid and his damages by Occasion of the detaining of the Same debt to 217 Two hundred and Seventeen pounds of tobacco to the Same John of his assent by the Court here adjudged with Stay of Execution of till next Court and ye afd deft in Mercy &c
hundred and thirty two with force and arms &c at the County of Somerset afd in and upon a Certain Henry Fitzwaters in the Peace of God and the afd Lord proprietary then and there being an assault made and him then and there beat wounded and Evill Intreated so that of his Life it was greatly despaired and other Enormitys to him then and there offered to the Grievous Damage of him the Said Henry and against the Peace of the right honrble the Lord proprietary T Bluett & Dom prop Testes Joseph MccCaster, John Sheldon, James Mumford, John Magan Margaret Peal, Littlton Towensand, Joshua Merrill, John Dennis Joshua Porter, Patrick Conelly Henry Fitzwaters on the back Side of the foregoing bill of Indictment it was thus Endorsed Vizt Ignoramus Jam.s Round foreman
