pounds of tobacco by the Same James in form aforesaid Confessed as also One hundred and Eighty Seven
pounds of tobacco for his Costs and Charges aforesaid to the Same John at his request by the Court thereof ^and^ his assent
of the parties afd adjudged with Stay of Execution till next Court and ye aforesaid deft in mercy &c

Somerset County ss:  Be it Remembred that on the twenty first day of
march in that Same term Came hereinto Court John Stewart Jun by
Francis Allen his Attorney Exhibeted to the Justices here his Certain
bill against James Shirley Gent one of the Attorneys of the County Court of the Right
Honrble the Lord proprty here prsent here in Court in his own proper person of a plea
of Debt the tenor of w.ch bill follows in these words to the Justices of the right Honrble
the Lord propretary of the County Court here now held for the County of Somerset

Somerset County ss  John Stewart Jun by Francis Allen his Attorney Complains
of James Shirley Gent one of the attorneys of the County Court of the Right honrble
the Lord proprietary here present herein Court in his own proper person otherwise
Called James ^Shirley^ of Somerset County and province afd Gent for that the aforesd James
doth unjustly detain and hath not rendered to the Said John two thousand pounds
March Tobacco in Cask w.ch to ^him^ he oweth for that whereas the afd James the tenth
day of Septemb.r one thousand Seven hundred thirty and one at the County of
Somerset afd within the Jur of this Court by his Certain Writing obligatory did
acknowledge himself to be bound unto the Said John in the aforesd two thousand
pounds of tobacco in Cask to be paid the Said John when he Should be there unto
requested yet the Said James tho' often required the Said two thousand pounds of
Tobacco in Cask to the Said John hath not rendered but the Same to him hither to to
render hath Denied and Still doth deny and Unjustly Detaine to the Damage of
the Said John fifteen hundred pounds of tobacco aforesd and thereupon he pray remedy
and brings into Court here the writing afd which Debt aforesd in forme aforesd doth
wittness whose date is the day and year afd &c       And the afd James Shirly
by Levin Gale his Attorney Comes and Defends the force and Injury when &c
and prays Leave thereof to Imparle here untill the Next Court and he hath it and
the Same day is given to the afd John here also &c    Att which said Next Court to
witt the twentieth day of June Ann Dom one thousand Seven hundred and
thirty two Came againe as well the afd John Stewart as the afd James Shirley
by there attorneys afd and the Said James Shirley says that the Justices of the
Lord propretary hereto proceed in the Cause aforesd between him the Said John
