214 thousand pounds of tobacco to the ^said^ John he hath paid and Satisfied yet as to thirteen hundred pounds of tobacco residue of the aforesd four thousand pounds of tobacco the Said James his promise and assumption aforesd in forme afd made Nothing regarding but Plotting and fraudulently ^intending^ the Said John in that pte Craftilly and Subtilly to Deceive and Defraud the Said thirteen hundred pounds of Tobacco to the Said John altho the Same to do the said James by the said John on the twenty Seventh Day of July in the year aforesd and often afterwards at Somerset County afd within the Jur afd he was thereunto requested hath not paid but the Same to him he therto pay hath refused and Still doth refuse and Deny to the Damage of the Said John two thousand Six hundred pounds of tobacco and thereupon he bring Suit &c
And the afd James Shirley in his owne proper person Comes and Defends the force and Injury when &c and prays Leave thereof to Imparle here untill the Next Court and he hath it and the Same day is given to the afd John here also &c Att which said next Court to witt the twentieth day of June anno Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid John Stewart by his attorney aforesaid as the aforesaid James shirley in his proper person and the Same James as before defends the force and Injury when &c and Says that he Cannot Gainsay the action aforesaid of the aforesaid John nor Can he Say but that he did assume upon himselfe in manner and form as the aforesaid John above against him Complained and as to the damage of the Same John by him by Occasion of the premisses in that part Sustained the Same James Saith and Confesseth that the aforesaid ^John^ Sustained damages by Occasion of the premisses beyound his Costs and Charges by him about his Suit in that part apposed to thirteen hundred pounds of tobacco and noe more and because the aforesaid John deny's not this but the same ag allegation Confesseth to be true prays Judgmt and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid John Stewart Recover against the Said James Shirley his damages aforesaid to the afd thirteen hundred pounds |
