212 premisses beyound his Costs and Charges in that part apposed to Four pounds Nine shillings and Six pence Curr money and not more and because the aforesaid Moses denyes not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid Moses Chaille Jun.r Recover against the aforesaid Thomas Lord his damages aforesaid to the aforesaid Four pounds Nine shillings and Six pence Curr money by the Same Thomas in form aforesaid Confessed as also two hundred and fifty Six pounds of tobacco for his Costs and Charges aforesaid to the Same Moses at his request by the Court here and Consent of the parties aforesaid adjudged and ye afd deft in Mercy &c Whereupon the aforesaid Thomas Lord in his proper person present herein Court at the prayer of the aforesaid plft is Committed into the Custody of the sher of Somerset County by Occasion of the premisses afd thereto remain untill the Said Moses of his damages and Costs aforesaid should be fully Satisfyed &c &c March Court 1731
Court of the Right honerble the Lord prorty here present herein Court in his own proper person of a plea of trespass upon the Case &c the tenor of which bill follows in these words to the Justices of the right horble the Lord propry of the County Court here now held for the County of Somerset &c Somerset County ss: John Stewart Jun by Francis Allen his attorney Complains of James Shirley Gent one of the Attorneys of the County Court of the Right Honrble the Lord proprty here present here in Court in his own proper pson of a plea of trespass upon the Case &c for that where as the afd James the fifteenth day of Octob.r Ann Dom Seventeen hundred and thirty one at the County of Somerset afd within the Jur of this Court was Indebted unto the Said John in Seven pounds Nineteen Shill.s and Eleven pence half Peny Curr.t Money of maryland for Sundry properly Chargable in account as by account hereof hereunto annexed may in Court appear and being so thereof Indebted the Said James in consideration thereof the day and year afd at the Place aforesd within the Jur afd upon himself did assume and to the Said John then and there did faithfully promise that he the said James the afd Seven pounds Nineteen Shillings and Eleven pence half Penny to the Said John when he Should be thereunto Requested he would well and faithfully pay and Content and Altho the Said James four pounds Seven Shillings and three pence pcell of the afd Seven pounds Nineteen Shillings and Eleven pence half peny to the Said John he hath paid and and Satisfied yet as to three pounds Twelve Shillings and Eight pence half |
