the Said Thomas the twentieth Day of July Ann Dom Seventeen hundred and thirty one at Somerset County afd within the Jur of this Court was Indebted unto the Said Moses in four pounds Nine shillings and Six pence Current money of maryland for Sundry properly Chargable in acc.t as by acc.t hereunto Annexed may in Court appear and being so thereof Indebted the said Thomas in Consideration thereof the day and Year afd at Somerset County afd within the Jurisdiction aforesaid upon himselfe did assume and to the Said Moses then and there did faithfully promise that he the Said Thomas the Said four pounds nine shillings and Six pence to the Said Moses when he should be thereunto requested he well and faithfully pay and Content Nevertheless the Said Thomas his promise and Assumption afd in forme aforesd made Nothing Regarding but plotting and fraudulently Intending the said Moses in that pte Craftilly and Subtilly to Deceive and Defraud the afd four pounds Nine Shillings and Six pence to the Said Moses Altho' the Same to do the Said Thomas by the aforesd Moses on the afd tenth day of July in the Year afd and often afterwards at Somerset County afd within the Jur afd he was thereto Required hath not paid or to him for the Same in any Sort Contented but the Same to him hitherto to pay or any sort to Content hath Refused and Still doth refuse and Deny whereupon he Saith he is worse and hath damage Damage to the Value of Eight Pounds Money aforesd and thereupon he brings Suit &c
and as to the damage of the same Moses by him by Occasion of the premisses in that part Sustained the Said Thomas Saith and Confesseth that the aforesaid Moses sustained damage by Occasion of the premisses |
