213 half Peny Residue of the aforesd Seven pounds Nineteen Shillings and Eleven pence half peny the Said James his promise and assumption afd in forme aforesd made nothing Regarding but plotting and fraudulently Intending the Said John in that Pte Craftilly and Subtilly to Deceive and Defraud the Said three pounds twelve Shillings Eight pence half Penny to the John Altho the Same to do the Said James by the Said John on the tenth Day of Decemb.r in thee year aforesd and often afterwards at Somrset County aforesd within the Jur aforesd he was thereunto Requested hath not paid but the Same to him hitherto to pay hath Refused and stilll doth Refuse and Deny to the Damage of the said John Seven pounds money aforesd and thereupon he brings Suit &c
And the aforesd James Shirly by Levin Gale his attorney Comes and Defends the force and Injury ^when^ &c and prays Leave thereof to Imparle here untill the Next Court and he hath it and the same day is given to the afd John here also &c Att which said next Court to witt the twentieth day of June ann.o Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid John Stewart as the afd James Shirley be their attorneys aforesaid and the Said James Shirley as before defends the force and Injury when &c and Saith that he did not assume upon himselfe in manner and form as the aforesaid John above against him hath Complained alledged and of this he puts himselfe upon the Country &c and ye afd plft in like manner And |
