211 fraudulently Intending him the Said John in that part Craftilly and Subtilly and Subtilly to Deceive and Defraud he the Said W.m one pound fifteen Shillings & Eight Pence Current Money nor any pte thereof had to the Same John hath Paid or him for it in any wise Contented Altho' the Said W.m the Same to do afterwards to witt the Same day and year afd at the County aforesd and within the afd Jurisdicon was requested but the Said W.m the Same to do hitherto hath refused and Still doth refuse whereby the Same John Saith he is Worse and hath Damage to the Value of three pounds Eleven Shillings and four pence Like Money and thereof brings Suit &c Janry 14.th 1731/2
And the afd W.m Wye by W.m Beckingham his Attorney Comes and Defends the force and Injury ^when^ &c and prayed Leave thereof to Imparle here untill the Next Court and he hath it and the Same Day is given to the afd John Tunstall Here also &c Att which said next Court to witt the twenty^eth^ first day of June Anno Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid John Tunstall as the aforesaid William Wye by their attorneys aforesaid and the Said William Wye as before defends the force and Injury when &c and Says that he Cannot Gainsay the action aforesaid of the aforesaid John nor but that he did assume upon himselfe in manner and form as the aforesaid John above against him has Complained and as to the damage of the Same John by him by occasion of the premisses in that part Sustained the Same William Says and Confesseth that the aforesaid John hath Sustained damages by Occasion of the premisses beyound his Costs and Charges by him about his Suit in that part apposed to One pound fifteen shillings and Eight pence and not more and because the aforesaid John Deny's not this but the Same allegation Confesseth to be true prays Judgnm.t and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid John Tunstall recover agt the aforesaid William Wye his damages aforesaid to the aforesaid One pound fifteen shillings and Eight pence Curr money by the Same William in form aforesaid Confessed as also pounds of tobacco for his Costs and Charges aforesaid to the Same John at his request by the Court here of his & assent of ye parties afd adjudged which Certain damages in the whole do amount to One pound fifteen (224) shillings and Eight pence Currant Money and Two hundred & Twenty four pounds of tobacco with Stay of Execution for thirty days ye aforesaid deft in Mercy &c |
