209 Att which said next Court to witt the twenty first day of march ann Dom One thousand seven hundred & thirty One Came againe as well the aforesaid Thomas Fletcher as the aforesaid John Records by their attorneys aforesaid and whereupon the same John prays Further Leave thereof to Imparle here untill the next Court and he hath it and the same day is Given to the aforesaid Thomas Here also &c Att which Said next Court to witt the twentieth day of June anno Dom One thousand Seven hundred and thirty two Came again as well the aforesaid Thomas Fletcher as the aforesaid John Records by their attorneys aforesaid and the Same John as before defends the force and Injury when &c and saith that he is in no sort Gilty of the premisses above against him declared alledged and thereof he puts himselfe upon the Country and the plft in Like manner Thereupon Command is Given to the sher of Somerset County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c and afterwards in in the Same Court Came the Said sher to witt Joshua Caldwell Gent and makes return that he hath here ready twelve &c As by his said preceipt he was Commanded and afterwards to witt the Same day & Year Last mentioned Came as well the aforesaid plft as the Same deft by their attorneys afd and the Jurors of that same Jury Impannelled being Called Came to witt James MccMorie, Cannon Winright, Robert Mitchel, John Webb Richard Knight, Edward Maglamory Edward Beachamp William Colebourn Thomas Peal, Michael Holland Joshua Merrill and Lewis Disharoon who to say the truth in the premisses being elected tryed and Sworn upon their Oath did Say that the aforesaid John Records is Guilty of the premisses in manner and form as the aforesaid Thomas Fletcher by his declaration aforesaid against him Complained and assessed the damages of the same Thomas by Occasion of the premisses beyound his Costs and Charges by him about his Suit in that part apposed to five hundred and Seventy One pounds of tobacco and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the aforesaid Thomas Fletcher Recover against the aforesaid John Records his damages aforesaid by the Jurors aforesaid in form aforesaid assessed as also six hundred and Eighty Seven pounds of tobacco for his Costs and Charges aforesaid to the Same Thomas by the Court here of his assent of Increase adjudged which Certain damages in the whole do amount to 687 Twelve hundred and fifty Nine pounds of tobacco and the aforesaid John in mercy &c and whereupon the aforesaid Thomas Fletcher Freely herein Court releaseth to the aforesaid John Records one hundred pounds of tobacco percell of the damages aforesaid Therefore the Same John of the same one hundred pounds of tobacco be thereof quiet &c
