 Somerset ss  John Reckards Late of Somerset County Planter
was Attached to answere unto Thomas Fletcher of a plea of
trespass upon the Case &c             And whereupon the Said
Thomas by Francis Allen his attorney Complaines that whereas ^he^ the Said Tho.s
the first day of October Ann Domini Seventeen hundred and thirty at Somrset
County afd within the Jur of this Court was porssessed of one hogshead of tobacco
weighing Neat four hundred Seventy one pounds of the Value of four pounds
Currant Money of maryland as of his proper hoghead of tobacco and being so
thereof possessed the Said hoghead of tobacco out of ^his^ hands and possession Causually
Lost w.ch Said Hoghed of Tobacco afterwards to witt on the first day of March in the
year aforesd at Somerset County afd within the Jur to the hands and possesion
of the aforesd John by finding came    Nevertheless the Said John knowing the
hoghead of Tobacco afd to be the proper hh.d of Tobacco of him the Said Thomas &
to him the Said Thomas of right to belong and appertain but Plotting and
fraudulently Intending the Said Thomas of the hh.d of Tobacco afd Craftilly
and Subtilly to Deceive and Defraud the hh.d of Tobacco aforesd tho' often thereunto
requested to the Said Thomas hath not Delivered but the hh.d of Tobacco
aforesd Afterwards to witt on the first day ^of^ may Ann Domini Seventeen
hundred and thirty one at Somerset County aforesd within the Jurisdiction afd
to his own proper use did Convert and Dispose to the Damage of the Said Tho.s
of tenn pounds money aforesd and thereupon he brings Suit &c          And the
afd John Records by W.m Beckingham his Attorney Comes and Defends the
force and Injury when &c and prays Leave thereof to Imparle here untill
the Next Court and he hath it and the Same day is given to the afd Thomas
here also &c       Att which said Next Court to witt the Seventeenth day of
August Ann Dom one thousand Seven hundred and thirty one Came again
as well the afd John Thomas Fletcher as the afd John Records by their
Attorneys afd and Whereupon the Same John prays further Leave
thereof to Imparle here untill the Next Court and he hath it and the
same day is given to the afd Thomas here also &c       Att which said next
Court to witt the Sixteenth day of November ann Dom one thousand
seven hundred and thirty one Came againe as well the aforesd Thomas
Fletcher as the afd John Records by their Attorneys afd and whereupon
the Same ^John^ Thomas Prays further Leave thereof to Imparle here untill
the Next Court and he hath it and the same day is given to the aforesd
Thomas here also &c
