June Court                       1732                     209

Seventeen hundred and thirty at Somerset County aforesd within the Jur of this
Court was Indebted unto the Said John in the Sum of thirty one pounds thirteen
Shillings Current as well for Sundry goods wares and Merchandizes by the said
John to the Said Nath.l at his Especiall Instance and request there before that
time Sold and Delivered as for Sundry other things which Lyeth properly in
account as by account hereunto annexed may in Court appear and being so
thereof being Indebted the Said Nath.l in Consideration thereof the day and year
aforesd at the County afd within the Jur afd upon himself did assume and to
the Said John then and there did faithfully promise that he the Said Nath.l
the afd thirty one pounds thirteen Shillings to the Said John when he should
be thereunto requested he would well and faithfully pay and Content and altho
the Said Nath.l hath paid unto the Said John Eight pounds Nine Shillings
and Nine pence pcell of the afd thirty one pounds thirteen Shillings yet as to
twenty three pounds three Shillings and three pence residiue of the aforesaid
thirty one pounds thirteen Shillings the Said Nath.l his promise and
assumption afd in forme aforesd made Nothing regarding but plotting and
fraudulently Intending the Said John in that part Craftilly and Subtilly to
Deceive and Defraud the Said twenty three pounds three Shillings and three
Pence to the Said John Altho the Same to do the Said Nathaniel by the said
John on the aforesd Eight Day of November in the year afd and often afterwards
at Somerset County afd within the Jur afd he was thereunto Requested hath
not paid or Contented but the Same to him hitherto to pay or Content hath refused
and Still doth refuse and Deny  Whereupon the Said John Saith he is worse and
hath Damage to the Value of fifty pounds Current Money and thereupon he
brings Suit &c          And the afd Nath.a Horsey by Francis Allen his Attorney
Comes and Defends the force and Injury when &c and prayed Leave thereof to
Imparle here untill the Next Court and he hath it and the Same day is given
to the afd John here also &c    Att which Said Next Court to witt the Sixteenth
day of November ann Dom one thousand seven hundred and thirty one
Came againe as well the afd John Outerbridge as the afd Nath.l Horsey by
their Attorneys afd and whereupon the Same Nath.l prays further Leave
thereof to Imparle here untill the Next Court and he hath it and the same
day is given to the afd John here also &c       Att which said next Court to
witt the twenty first day of March anno Dom one thousand Seven hundred
and thirty one Came againe as well the afd John Outerbridge as the afd Nath.l
