Edmond Fitzgarell by their attorneys aforesd and Whereupon the Same Edmond
Prays further Leave thereof to Imparle here untill the Next Court and he hath
it and the same day is given to the aforesd John here also &c       Att which
said Next Court to witt the Sixteenth day of November Ann Dom one
thousand Seven hundred and thirty one Came againe as well the afd John
Follows as the aforesd Edmond Fitzgarell by their Attorneys aforesd and
whereupon the Same Edmond prays further Leave thereof to Imparle
here untill the Next Court and he hath it and the Same day is given to the
afd John here also &c      Att which said Next Court to witt the twenty first
day of March anno Domini one thousand seven hundred and thirty one
Came againe as well the aforesd John Follows as the afd Edmond Fitzgarell
by their attorneys aforesd and whereupon the Same Edmond prays
further Leave thereof to Impare here untill the Next Court and he hath it
and the same day is given to the afd John here also &c

       Att which said next Court to witt the twentieth day of June ann.o Dom One thousand Seven hundred
and thirty two Came again as well the aforesaid John Followes as the aforesaid Edmond Fitzgerrell by
their attorneys afd and whereupon the Said John Follows by his ^said^ attorney prays that the Said Edmond
to his declaration aforesaid may answer but the Same attorney of the same Edmond says that
he is not Informed by his Clyant of any answer for the Same Edmond to the aforesaid John in ye
plea aforesaid to be Given and nothing els thereof says by which the same plft remaineth
against the aforesaid deft thereof undefended &c

             Wherefore the aforesaid John Follows his damages by Occasion of the Nonperformance
of the promisse and assumption aforesaid against the Same Edmond Fitzgerrell Ought to recover
&c    whereupon at the prayer of the Same John Follows and by the Consent of the afd Edmd
Fitzgerrell the Justices here according to act of assembly in Such Case made and provided assessed
the damages of the Same John by Occasion of the Non performance of the promise and
assumption aforesaid beyound his Costs and Charges by him about his Suit in that part apposed
to three pounds three shillings and three pence Currant money

                Therefore it is Considered by the Justices here that the aforesaid John Follows recover
against the aforesaid Edmond Fitzgerrell his damages aforesaid to three pounds three shillings
and three pence Currant money by the Justices aforesaid in form aforesaid Confe assessed as
212    also two hundred and thirty Eight           pounds of tobacco for his Costs and Charges to ye
238   Same John at his request by the Court here adjudged and the afd defendt in Mercy &c
