1732 107 what Damages the afd Will.m Sustained as well by occasion of the Premises as for his Costs and Charges by him about his Suit in that part apposed and the Inquesition wch thereof he takes ^to^ the Justies of his Lordships County Court of Somrset to be held at Dividng Creek the third tuesday of August Next under his Seal and the Seals of them by whose Oaths he takes the Same he Send together with his Lordships Writt to him Directed and the Same day is given to the aforesd Will.m there also &c

Day of March Ann Domini one thousand Seven hundred and thirty at Somrset County within the Jur of this Court was Indebted unto the Same John Follows In the Sum of three pounds three Shillings and three pence Currant Money and so thereof being Indebted the Said Edmond afterwards to wit the Same day and year aforesaid at the County aforesaid within the aforesd Jurisdicon in Consideration thereof upon himself assumed and to the Said John Follows then and there faithfully did Promise that he when Afterwards he Should be thereunto requested he the aforesd Sum of three pounds three Shillings and three pence Currant money to the Same John Follows well and faithfully would Content and pay Nevertheless the Said Edmond his promise and Assumption afd in forme afd made Little Regarding but Plotting and fraudulently Intending him the said John in that parte Craftilly and Subtilly to Defraud and Deceive he the Said Edmond the aforesd Sum of three pounds three Shillings and three pence nor any pte thereof to the Same John hath paid or him for it in aways Contented altho the same Edmond the same to do afterwards to witt the same day and Year aforesd at the County afd and within the aforesd Jur was requested but the Said Edmond the same to do hitherto hath refused and Still doth refuse whereby the same John Saith he is worse and hath Damage to the Value of seven pounds Curr.t Money and thereof he brings Suit &c And the aforesd Edmond Fitzgarell by prays Leave thereof to Imparle here untill the Next Court and he hath it and the Same day is given to the afd John here also &c Att which said Next Court to witt the Seventeenth day of August ann Dom one thousand Seven hund and thirty one Came againe as well the afd John Follows as the afd Edmond |
