205 Walter Jacobs and Eliz.a his wife by their attorneys aforesaid and whereupon the Same Walter and Eliza pray Further Leave thereof to Impare here untill next Court and they have it and the Same day is Given to the aforesaid John here also &c Att which Said next Court to witt the twentyeth day of June ann.o Dom One thousand seven hundred and thirty two Came againe the aforesaid John Nicholson by his attorney aforesaid and prays that the aforesaid Walter Jacobs and Eliz.a his wife to his declaration aforesaid may answer and the aforesaid Walter Jacobs and Eliz.a altho at the Same day Solemnly Called Commeth not nor nothing says in barr or preclusion of the action aforesaid of the aforesaid John by which the Same John remaineth thereof against them undefended &c Therefore it is Considered that the aforesaid John Nicholson recover against the aforesaid Walter Jacobs and Eliz.a his wife adm.rx of the aforesaid Christopher Dashiell his debt aforesaid as also his damages by Occation of the detaining of the Same debt to two hundred and fifty three 253 pounds of tobacco to the Same John of his assent by the Court here adjudged to be Levied of the Goods and Chattells which were of the aforesaid Christopher Dashiell at the time of his death in the hands of the Same Walter and Eliz.a to be administred if so much in their hands they have and if so much in their hands they have not then the damages aforesaid to be Levied of the proper Goods and Chattells of the aforesaid Walter and Eliz.a and ye afd defts in mercy &c
Complains that whereas he the said James Nairne is a good true and faithfull Subject of our Lord the king that now is and of good Name fame Conversation and Condition as well amongst his Neighbours as other faithfull Subjects of the Said Lord the king now and allways was held and reputed and without any Crime of Perjury deceitt or falistty from the time of his Nativity hither to unhurt untouched and unsuspected hath behaved and Demeaned himself and Whereas also the Said James Nearne by Vertue of a Comission from the Worshipfull the Justices of Somerset County Court to him the Said James Nearne and a Certain Robert Nearne Jun William Holland and John Outen directed bearing date the day twenty fourth day of November Ann Dom Seven hundred and thirty to Examine Evidences on behalf of a Certain Samuel Riggin in relation to the bounds of a part of a tract of Land Lying |
