204 of the Costs afd in the writt of Scirefacias aforesaid mentioned according to the force form and effect of the recovery aforesaid &c
to answere unto John Nicholson of a plea that they render unto him ten pounds Currant Money which from him they Unjustly Detains &c And Whereupon the Same John by Levin Gale his Attorney Saith that whereas the aforesaid Chris in his Life time to witt the first day of January one thousand Seven hundred and twenty three four three at Somerset County within the Jur of this Court by his Certain writing obligatory granted himself to be held and firmly Bound unto the aforesd John in the afd Sum of ten pounds Currant Money to be paid to the Said John when afterwards the Said Christopher Should be thereto required yet the aforesd Christopher in his Life time and the aforesd Eliz after the D^e^ath of the Same Chris whilest she was Sale Also the aforesd Walter and Eliz after the Espousals between them Celebrated altho often required the aforesd ten pounds Currant money to the Same John have not as yett rendered but the Same to him to render hath Denyed and the aforesd Walter and Eliz the same to the Said John as yet denyeth and Unjustly Detaineth whereby the Same John says he is worse and hath Damage to the Value of twenty pounds Like Money and thereupon he brings Suit &c and brings here in Court the writing afd which the debt aforesd in form aforesd doth Testifie &c And the said Walter Jacobs and Eliz.a his wife by George Dashiell their attorney Come and defend the force and Injury when &c and pray Leave thereof to Imparle here untill next Court and they have it and the Same day is Given to the aforesaid John Here also &c Att which said next Court to witt the Seventeenth day of august anno Dom One thousand Seven hundred and thirty One Came againe as well the aforesaid John Nicholson as the aforesaid Walter Jacobs and Eliz.a his wife by their attorneys aforesaid and whereupon the Same Walter and Eliz.a pray further Leave thereof to Imparle here untill next Court and they have it and the Same day is Given to the aforesaid John here also &c Att which Said next Court to witt the Sixteenth day of November anno Dom One thousand seven hundred and thirty One Came againe as well the aforesaid John Nicholson as the aforesaid Walter Jacobs & Eliz.a his wife by their attorneys aforesaid And whereupon the Same Walter and Eliz.a pray further Leave thereof to Imparle here untill next Court and they have it and the Sam day is Given to the aforesaid John here also &c Att which said next Court to witt the twenty first day of March anno Dom one thousand Seven hundred and thirty One Came againe as well the aforesaid John Nicholson as the afd (Walter) |
