197 his estate out of this County to deceive his Creditors You are therefore hereby Required to Issue an attachment on behalfe of Joshua Merrill for the Sum in the account here sent you with the Incident Costs and Charges according to the form of the act of assembly in Such Case made and provided and for your so doing this shall be your Sufficient Warrent Given under my hand this 3.d day of aprill ann.o Dom 1732 Wm Lane To Mr Thomas Hayward Cl of Somerset County In pursuance to an act of assembly of this province now in force and in Obedience to the aforesaid Warrent the following attachment was Issued against the Goods and Chattells Rights or Credits of the aforesaid Theophilus Dennis the tenor whereof followeth in these words vizt Somerset ss Charles absolute Lord and proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &c to the sher of Somerset County Greeting we Commad you that you attach any the Goods Chattells rights or Creditts of Theophilus Dennis Late of Somerset County planter if they shall be found in your Bailywick to the Value of One pound fourteen shillings Curr.t money and three hundred pounds of tobacco and when you have the Same attached or any part thereof the Same in Your Custody safe keep so that you have the same before Our Justices of Our County Court of Somerset to be held at dividing Creek the third tuesday of June next then and there to be Condemned according to act of assembly to and for the Use of a Certain Joshua Merrill unless the Said Theophilus Dennis by himselfe or his attorney shall appear and answer unto the Said Joshua Merrill in a plea of trespass upon the Case &c According to Law and that by Good and Lawfull men of your bailywick you make known unto the person or persons in whose hand you make the Same attachment that ^he^ she or they be and appear before Our Justices of our County Court to be held and aforesd to Shew Cause if any he she or they have why the Same goods Chattells Rights or Creditts so Attached in his her or their hands ought not to be Condemned and Execution thereof had and made According to act of Assembly in Such Case made and Provided if to him her or them it Shall Seem me^e^t and how you Shall Execute this Writ that you make known unto our said Justies at the day and place aforesd and have you then and there this writt Wittness Sam.l Hopkins Gent Chief Justices of our said Said Court the twenty fifth day of March In the Seventeenth Year of our Dominion &c Ann Dom one thousand seven hundred and thirty two Att which Said third tuesday of June Next to witt the twentyeth day of the Same Month ann Dom one thousand Seven hundred and thirty two being the day of the returne of the Said Writt Cometh the afd Joshua Merrill in his proper person and the Sher of Somerset County to whome the foregoing writt was Directed Likewise Comes and makes returne thereof to the Court here Endorsed Vizt By vertue of the within Writt to me directed to the Justices within Mentioned I Certifie that on the |
