the                 of                 I attached in the hands of David Goggin two Stears to the Value of thirty
shillings each and in the hands of Bailey Fisher to the Value of thirty five shillings Curr.t money and by
John Dennis Jun.r and Joshua Merrill that they be and appear to shew Cause &c    Joshua Caldwell sher

    Whereupon the aforesaid Tho Bailey Fisher in his proper person (Gar of the said Theophilus Dennis)
appears and says that he Cannot Gainsay but that he has of the rights and Credits of the Said Theophilus
to the value of twenty one shillings Curr money nor Can he Say but that the Same Ought Condemned in his
hands for the Use of the Said Joshua Merrill as of the rights of the said Theophilus which ye said Joshua
doth not Gainsay
                                    Whereupon the Said Joshua by Francis Allen his attorney prays that upon Giveing
Security according to act of assembly the afd sum of twenty one shillings Curr money so as afd Confessed
by the aforesaid Baily Fisher as of the Rights and Creditts of the Same Theophilus may be Condemned
in ye hands of the Said Bailey towards Satisfying unto the Said Joshua the afd Sum of One pound fourteen
shillings and three hundred pounds of tobacco in the attachment afd mentioned &c

       Whereupon Littleton Townsend of Somerset County planter present herein Court in his proper person
undertakes for the Said Joshua Merrill that in Case ye Said Theophilus Dennis shall at any time hereafter
appear within a year and a day appear and make all or any part of the Said Joshua Merrills Claim
against him to be Satisfied or Otherwise undue before the Laying of the attachment aforesaid that then
ye Said Joshua Merrill shall make restitution unto the Said Theophilus of all or such part thereof as shall
be made appear to be undue &c or that he ye Said Littleton Townsend will do the same for him &c

          Therefore it is Considered that the aforesaid sum of twenty One shillings part of the sum so attached
and Confessed be Condemned in the hands of the said Baily Fisher as of the rights and Creditts of the
said Theophilus Dennis towards satisfying unto the said Joshua Merrill as well the afd sum of One pound
fourteen shillings Curr money and three hundred pounds of tobacco as also all Costs accrewing upon the writt
of attachment aforesaid and that he have thereof Execution against ye Said Baily Fisher according to act
of assembly &c    whereupon the said David Goggin appears ^in his^ proper person & Imparles till next Cort
the following account should have been Entered at the foot of ye warr but was Omitted & Entered here &c

                To Eleven shillings and Six pence                                      11..6
                To Serving 2 warrents for you                                             5..          then the above account was

          his Creditors you are hereby Required to Issue an Attachment on behalf of Saul Towensand
