196 Justic of our said Court the twenty Second Day of March In the Seventeenth Year of our Domminion &c Ann Dom one thousand Seven hundred and thirty one Att which Said third tuesday of June to witt the twentyeth day of the Same Month Anno Dom one thousand Seven hundred and thirty one being the day of the return of the Said Writt Cometh the aforesd Levin Gale in his proper Person and the Sher of Somerset County to whome the foregoeing writt was Directed ^Likewise^ Comes and Makes returne thereof to the Court here Endorsed Vizt according to the within writt to me derected I have attached to the Value of Six pounds Currant Money of Maryland and in the hands of George Baley and Abigall Kibell as Wittness my hand Jsa Caldwell Sher Whereupon the aforesaid George Bailey Garnishee of the aforesaid John Persons altho' Solemnly Called Came not nor shews Cause why &c but makes default Whereupon the afd Levin Gale present herein Court in his properson prays that upon Giving Security according to act of assembly in such Case made and provided the afd Sum of Six pounds Curr money so as aforesaid attached may be Condemned in the hands of the aforesaid George Bailey as of the Rights and Creditts of the aforesaid John Persons towards satisfying unto him as well the sum of five pounds Curr money mentioned in the attachment aforesaid as also all Costs accrewing by means of the same attachment &c which is to him Granted &c Thereupon a certain William Stoughton of Somerset County Gent present herein Court in his proper person undertakes for the Said Levin Gale that in Case the Said John Persons shall at any time within a year and a day appear and make all or any part of the Said Levin Gales Claim against him to be satisfied or otherwise undue before the Laying of the attachment aforesaid that then the Said Levin Gale shall make restitution unto the said John Persons of all or such part thereof as shall be made appear to be undue &c or that the said William Stoughton will do the same for him &c Therefore it is Considered by the Justices here that the aforesaid Sum of Six pounds Cur money so as afd attached may be Condemned in the hands of the said George Bailey as of the rights and Credits of the Said John Persons toward Satisfying unto the Said Levin Gale the aforesaid sum of five pounds mentioned in the attachment aforesaid as also all Costs accrewing thereon and that the afd Levin Gale have thereof his Execution against the Said Geo Bailey according to act of assembly &c whereupon the afd Abigaill Kibble Garnishe as aforesaid is by Consent of the afd Levin Gale discharged from the attachment afd &c
