195 they had there ready twelve &c as aforesaid they were Commanded and the Jurors of that Same Jury by the aforesaid Coroners Impannelled being Called Came to witt James Mackmorie, Joseph Houston, John Atkinson John Webb, Robert Mitchell, John Tull, John Broughton Lazarus Maddox Thomas Collins John Donelson, John Records and Robert Givans who to Say the truth of the premisses being Elected tryed and Sworn upon their Oath did Say that the afd William Horsey is Gilty of the trespass and assault aforesaid in manner and form as by the Indictment aforesaid above against him ^is^ supposed Whereupon all and Singular the premisses by the Court here being seen heard and fully understood It is Considered by the Court here that the aforesaid William Horsey pay to his Lordship the Lord proprietary for his fine by the Court here upon him Imposed for and by Occasion of the trespass and assault aforesaid whereof in form aforesaid he is Convict five hundred pounds of tobacco and that the Said William Horsey be taken to Satisife his Said Lordship of the fine aforesaid thereupon the aforesaid William Horsey is Committed under the Custody of the Sher of Somerset County there to remain untill he Satisfie the Severall Officers their fees due by Occasion of the premisses &c whereupon the Said Sher to witt Joshua Caldwell Gent present here in Court took Charge of ye Said William Horsey accordingly &c
aforesd in and upon a Certain John Follows (the said John Follers then being Constable of great Moome hundred in the County of Somerset aforesd) in the Peace of God and the aforesd Lord proprietary and in the Execution of his office aforesd then and there being an assault made and him then and there beat wound^ed^ and Evill Intreated so that of his Life it was Greatly Despaired and other Enormitys to him then and there offered to the Grievous Damage of him the Said ^John^ and against the Peace of the Right Honble the Lord proprtary &c and against the form of the afd of assembly in that Case made and provided &c T Bluett p Dom prop.r Thereupon Command was Given to the sher of Somerset County that he should take the Said Martin Henry if &c to answer &c and afterwards in the this Same Court before his Lordships Justices at dividing Creek to witt the twentieth day of June anno Dom One thousand Seven hundred and thirty two Came the afd Martin Henry in his proper person and had a hearing of the Indictment aforesaid and Says that he is not Gilty thereof and of this he puts himselfe upon the Country and Thomas Bluett who for his Said Lordship in this behalfe prosecutes Likewise Afterwards the afd Martin Henry present here |
