1732 192 found then and there feloniously Stole took and Carried away against the peace of the Right honrble the Lord proprietary &c and also against the form of the act of assembly in that Case made and provided L Gale P Dom Test The reverend Wm Wye, Wm Wye Jun.r Ann Hayman Bridgett Colligon, Susannah Floyde Sidney Brown and Eliza Brown On the Back side of the foregoing Bill of Indictment it was thus Endorsed viz.t Billa Vera Edward Rownd Foreman And in manner (to witt) at a Court held for the County of Somerset at dividing Creek the twenty first day of march Anno Dom One thousand Seven hundred and thirty one before his Lordships Justices of the same Court Cometh the aforesaid William Horsey according to a Certain Recognizance by him and his pledges in that part first acknowledged in his proper person and hath a hearing of the Indictment aforesaid and Says that he is not Gilty thereof and of this he putts himselfe upon the Country and Levin Gale Esq.r who for his said Lordship in that Followeth Likewise thereupon the aforesaid William Horsey at the prayer of the afd Levin Gale Esq.r (who for his Said Lordship in that part prosecutes) is ordered by the Court here to Give Security for his Good behaviour and appearance before the Justices of his Said Lordships County Court of Somerset to be held at dividing Creek the third tuesday of June then next to answer the Indictment aforesaid but for want thereof the said William Horsey is Committed into the Custody of the sher of somerset County there to remaine &c Att which said next Court to witt the twentieth of June anno Dom One thousand Seven hundred and thirty two before his Said Lordships Justices Came as well the afd Levin Gale Esqr who for his said Lordship in that part followeth as the aforesaid William Horsey in his proper person ^under^ in Custody of the sher ^of the County^ afd in whose Custody before that time was Committed for the Case afd Whereupon Command was Given to the Coroners of Somerset County that Immediately they should Cause to Come here twelve &c by whom &c who neither &c to recognize &c and afterwards in the Same Court Came Henry Ballard and William Lane Gent.m Coroners of the County afd and made return that they had there ready twelve &c as aforesaid they were Commanded and thereof before the afd Justices Last mentioned Cometh the Jury and the Jurors of that Same Jury by the afd Coroners being Impannelled and Likewise Called Came to witt Edward Rownd, James MccMorie Joseph Houston John Atkinson John Webb, Robert Mitchell, John Tull, John Broughton Lazarus Maddox, Thomas Collins, John Collins Donelson and John Records who to say the truth in the premisses being duly Elected tryed and Sworne &c And for as much as as it doth appear to the Court here that One of the Jurors afd Impannelled and Sworn to witt Edward Rownd was foreman of the Grand Jury that Endorsed the Bill of Indictment abovesaid billa vera thereupon at the prayer of Levin Gale Esq.r who for his Said Lordship in this behalfe prosecutes the aforsaid Edward Rownds sworn on the Jury ^afd^ is withdrawn and all the rest of the Jurors Sworn as above were accordingly |
