193 accordingly discharged whereupon Levin Gale Esq.r who for his Said Lordship in that part prosecutes and for his Said Lordship prays that the Coroners aforesaid may be ordered to return a jury of new for trying the Issue aforesaid and to Him it is Granted &c thereupon Command is Given to the aforesaid Coroners that Immediately they return a Jury of New for the trying of the Issue aforesd and afterwards Came the Same Coroners here into Court and made return that they had here Ready the Jury as afd they were Commanded at which time Came as well the aforesaid Levin Gale who for his Said Lordship in that part prosecutes as the aforesaid William Horsey under Custody of the sher aforesaid in his proper person and the Jurors of that Same Jury by the aforesaid Coroners being Impannelled being Called Came to witt James Mackmorie Joseph houston John Atkinson, John Webb, Robert Mitchell John Tull John Broughton Lazarus Maddox Thomas Collins John Donelson John Records and Richard Knight who to Say the truth in the premisses being elected tryed and Sworn upon their Oath did say that the aforesaid William Horsey is not Gilty of the felony aforesaid in the Indictment aforesaid specified in manner and form as by the Indictment aforesaid above against him Supposed whereupon all and Singular the premisses being Seen and by the Court here understood Therefore it is Considered by the Court here that the aforesaid William Horsey be Quiet and go thereof without day &c also it is Considered by the Court here that the afd William Horsey Give Security for the payment of the Severall Officers their Fees due by Occasion of the premisses aforesaid but for want thereof the Said William Horsey is Committed into the Custody of the sher of Somerset County thereto remaine &c the Said sher to witt Joshua Caldwell Gent present here in Court took Charge of ye Said William Horsey accordingly &c William Wye Jun.r and William Wye Sen.r George Benston and Bridgett Colligan all Severally appear to their Recognizances and were accordingly discharged &c
relation to the bounds of a Certain tract of Land Lying in the County aforesd Called Mount Pleasant we there fore REquire you or any three or two of you at Some time and place as to you or any three or two of you Shall Seem Convenient you meet on the aforesd Land Called Mount Pleasant (you first haveing taken your Oaths on the holy Evangelist of Almighty God According |
