183 Sum of three Pounds seven Shillings and one penny half Peny According to the tenour of the Note afd and so being Lyable the afd James in Consideration thereof afterwards to witt the Same same twenty Sixth Day of april which was in the Year of our Lord God Seventeen hundred and thirty one aforesaid at Somerset County aforesd upon himself did assume and ^un^to the Same W.m Fasitt then and there faithfully did Promise to pay unto the aforesd W.m Fasitt the aforesd Sum of money according to the tenour of the Note aforesd Nevertheless the afd James his Promise and Assumption aforesd nothing regarding but minding and fraudulently intending the same Wm Fasitt in this Part Craftilly and Subtily to deceive and defraud the aforesd sum of Money or any part thereof unto the Same W.m Fasitt hath not paid altho' to do the same by the afd W.m Fasitt Afterwards to witt the first Day of May in the Year of our Lord God Seventeen hundred and thirty one at the County afd the afd James we required but that unto him hitherto to pay altogether hath refused and Still doth refuse and to the Damage of the Same W.m Fasitt Seven pounds and thereupon he bring Suit &c Pledges &c Jn Doe and R Roe Will Beckingham Att which said Third tuesday of march to witt the twenty first day of the Same month One thousand Seven hundred and thirty One being the day of the Return of the Said writt Cometh the Said William Fasitt by his attorney aforesaid and the Sherr of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here endorsed in these words following vizt Cepi Corpus P Joshua Caldwell sher Whereupon the said Sher altho' Solemnly Called brings not in the body of the Said James Andrews according to his return of the writt in the plea afd &c thereupon the Said William Fasit by his attorney afd prays that the afd Sher to witt Joshua Caldwell Gent may be annexed to his Lordship his damages and Costs for his default aforesaid Therefore it is Considered by the Court here the day and Year aforesaid and the Sher afd to witt Joshua Caldwell Gent be amerced to his Lordship the Lord proprietary the Sum of three pounds seven shillings and One penny half penny and two hundred and eleven pounds of tobacco for his noncomplyance with the tenour of his return afd and yt he be in mercy &c
of the Peace in the County afd to keep assigned and acknowledged themselves to |
