       March Court 1731                 182

Saith that he Cannot Gainsay but that he has of the Rights and Cred.ts of the said William Wye in his hands to ye
vertue of ^to^ the afd Eleven thousand five hundred pounds of tobo of the value of fifty five pounds ten shillings
so as afd attached nor Can he Say but that the Same ought to be Condemned in his hands for the use of the said
John Shapleigh as of the Rights and Creditts of the Said William Wye which ye said plft doth not Gainsay

    Whereupon the Said John Shapleigh by his attorney afd prays that the afd Sum of Eleven thousand five
hundred pounds of tobacco of the value of fifty five pounds ten Shillings Curr money so as afd attached
as of the Rights and Creditts of the afd William Wye may be Condemned in the hands of the aforesaid Joshua
Caldwell towards Satisfying unto the said John Shapleigh his debt and Costs afd as also all Costs accrewing upon
the writt of Attachment aforesaid &c

          Therefore it is Considered by the Justices here that the aforesaid Eleven thousand five hundred pds
of tobacco of the Value of fifty five pounds ten shillings Cur money so as aforesaid attached and
Confessed be Condemned in the hands of the aforesaid Joshua Caldwell as of the Rights and Creditts of
the Said William Wye towards Satisfying unto the said John Shapleigh his debt and Costs aforesaid
& al ^Costs^ accrewing upon the writt of attachment ^afd^ and that the Said John Shapleigh have thereof his Execution agt
against the Said Jos Caldwell according to act of assembly &c

Command was Given to the sher of Somerset County that he Should take
James Andrews Late of Somerset County planter if he Should be found in his bailywick
                               and him should safe keep so that he might have his body before the Justices of his
Lordships County Court of Somerset to be held at dividing the third tuesday of March then next to answer
unto William Fasit Jun.r of a plea of trespass upon the Case &c and that thereof he Should not fail &c

    And the said William Fasit by William Beckingham his attorney Complaineth against the Said James
Andrews in the plea aforesaid as followeth viz.t

Somerset County ss:   James Andrews Late of Somerset County planter was
attached to answere unto W.m Fasit Jun.r of a plea of trespass upon the Case &c
And Whereupon the same Will.m Fasitt Jun by W.m Beckingham his Attorney
Complaineth that whereas the aforesd James Andrews after the first day of
May in the Year of our Lord God Seventeen hundred and five to witt the twenty
Sixth Day of Aprill which was in the Year of our Lord God Seventeen hund.d
and thirty one at Somerset County afd did draw his Certain Note in writing
Called a promissory Note with his proper hand subscribed bearing date
the Same Day and Year Last mentioned and that Note and unto the same
W.m Fasitt then and there Did Deliver by which said Note the Same James
did promise to pay unto the Same Wm Fasitt or order the Sum of three
pounds seven shillings and one penny half Penny and by reason thereof
as also by force of the Statute in such Case Lately made and provided
the Same James became lyable to pay unto the Said W.m Fasitt the afd
