176 aforesaid is Immediately Committed by the Same Court into the Custody of the aforesaid Sher thereto remaine untill ye aforesaid John River of his debt and damages aforesaid should be fully Satisfied &c the Said sher to witt Joshua Caldwell Gent.m present here in Court took charge of the Said Walter Jacobs accordingly &c
the third tuesday of march then next to Satisfie William Holland as well of a Certain debt of one hundred pds Good and Lawfull money of the afd County which the Same William Holland in his Said Lordships County Court of Somerset before the Justices thereof at dividing Creek Recovered against him as of One thousand and fifty seven pounds of tobacco which to the Same William Holland in the Same Court were adjudged for his damages which he had by Occasion of the detaining of that Same debt whereof he is Convict &c Att which said third tuesday of march to witt the twenty first day of the Same month anno Dom One thousand Seven hundred and thirty one being the day of the Return of the Said writt Cometh the Said W.m Holland by Levin Gale his attorney and the Sher of Somerset County to whom the foregoeing Writt Was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in those words following vizt Cepi Corpus in Custody P Jos.a Caldwell sher Whereupon the aforesaid Robert Houston present here in Court in his proper person (and being by the sher set to the barr) is at the prayer of the aforesaid William by his attorney aforesaid Commanded into the Custody of the Sher of Somerset County there to Remaine untill the aforesaid William of his debt and damages aforesaid should be fully Satisfyed &c the Said sher (to witt) Joshua Caldwell Gent.m present herein Court took Charge of the Said Rob.t Houstone accordingly &c
Fleming her heirs Executors administrators or assignes to the which payment well and truely to be made and done we bind Our Selves and Either of Our heirs Executors and administrators for the whole and in the whole Joyntly and Severally firmly by these presents sealed with our Seal and dated this 24.th day of march Anno Dom 1731 The Condition of the above Obligation is Such that whereas the Commisary Generall hath Transmitted into this Court the account of the Estate of Lodowick Flemming decd wherein it is found that there is ballance due to the above said Orphans the Sum of Sixty five pounds and Seven shillings Currant money If therefore the above above said John Lay his Executors or administrators SHall and do well and truely pay or Cause to be paid unto the above named Lavina Flemming the aforesaid sum of sixty five pounds and Seven shillings Curr.t money according to act of assembly and ye dec.d Will when she shall arrive at full age to receive the Same &c then the above Obligation to be void & of none Effect Otherwise to remain in full force & vertue in law &c Jno Lay (Seal) Sealed and deld in the presents of Jno Donelson (seal) Wm Stoughton his Jam.s Martin Tho.s TC Collins (seal) marke |
