176 on the said Donnock prayeth further Leave ^thereof^ to Imparle hereuntill next Court and he hath it and the same day is Given to the aforesaid John here also &c Att which said next Court to witt the Sixteenth day of November ann Dom One thousand Seven hundred and thirty One Came againe as well the aforesaid John Sneed as the aforesaid Donnock Dennis by their attorneys afd and whereupon the Said Donnock prayeth further Leave thereof to Imparle here untill Next Court and he hath it and the Same day is Given to the aforesaid John Here also &c Att which Said next Court to witt the twenty first day of march anno Dom One thousand Seven hundred and thirty One Came againe as well the ^afd^ John Snead as the aforesaid Donnock Dennis by their attorneys afd and whereupon the Same Donnock as before defends the force and Injury when &c and saith that he of the premisses aforesaid above upon him Imposed is not Guilty thereof in manner and form as the aforesaid John above against him hath Complained and of this he puts himselfe upon the Country &c Whereupon the aforesaid Donnock prays that the aforesaid John may Reply to the plea aforesaid but ye Same John altho' Solemnly Called Cometh not ^nor^ to the plea of the afd Donnock Replyeth neither in his declaration aforesaid against the Same Donnock Further prosecuted &c Therefore it is Considered by the Court here that the aforesaid John Snead take nothing by his declaration aforesaid but that he and his pledges of prosecuting (to witt) John Doe and Richard Roe be in mercy and that the aforesaid Donnock Dennis Goe thereof without day &c and further it is Considered that the aforesaid Donnock Dennis Recover against the aforesaid John Snead two hundred & Ninety 290 pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same Donnock by the Court here according to the form of the Statute in Such Case Lately made and provided adjudged and that the Same Donnock have thereof Execution &c
third tuesday of march then next to Satisfie John Rider of Dorchester County Esq.r as well of a Certain debt of twenty One pounds and four pence Currant money which to the Same John Rider in his Said Lordships County Court of Somerset before the Justices thereof at dividing Creek recovered against him as of two hundred and Eighty Eight pounds of tobacco which to the Same John Rider in the Same Court were adjudged for his damages which he ha by Occasion of the detaining of that Same debt whereof he is Convict &c Att which said third tuesday of march to witt the twenty first day of the Same month anno Dom One thousand Seven hundred and thirty One being ye day of the Return of the Same Writt Cometh the Said John Rider by William Beckingham his attorney and the Sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Cepi Corpus in Custody P Jos.a Caldwell sher And the aforesaid Walter Jacobs present herein Court in his proper person as being by the Said sher sett o the Barr ^thereupon the said Walter Jacobs^ is Immediately at the prayer of the aforesaid John Rider by his attorney afd |
