August Court 1730
16 John Thompson of Somerset County planter being Sworn on the holy Evangelist of Almighty God deposeth and Saith that William Breretons fence in the Years 1718 and 1729 which parsed his dwelling plantation from John Waltoms begun at the Root of a stooping Ceader that stands Close by Passandike Creek about twelve yards to the northwestward of a hicory Marked with twelve Notches and that the said fence run from thence into the woods a Little to the northward of a line of ^trees^ marked with four Notches by the deponant and Isaac Noble the said deponant further deposeth and Saith that the Line of trees aforesaid is marked as neare to where the fence afd stood as it was possible to marke it and keep to the Eastward of it and further saith not Sworn before us Thomas Gills & Peter Sirman Owen Day of Somerset County planter aged about 45 Years being sworn upon the holy Evangelist of Almighty God deposeth and saith That he hath been acquainted with William Breretons Plantation about sixteen years and that the said William fence in the years seventeen hundred and Eighteen and seventeen hundred and Ninteen which parted his dwelling plantation from John Waltoms begun at the Root of a Ceader that stands Close by Passandike Creek about twelve yards to the northwestward of a hicory marked with twelve Notches and that the said fence run thence into the woods a very small matter to the northward of a Line of trees marked with four Notches by Isaac Noble and John Thompson the said deponant further saith that he verily believes the fence afd was the fence Intended in a deed made by the afd William Brereton to the reverend Mr Alexander Adams and further Saith not Sworn to before us Thomas Gillis & Peter Sirman We the Subscribers do hereby Certifie that the Severall Depositions of Isaac Noble Owen Day and John Thompson hereto annexed were taken and sworn to before us and that the fence and Line of trees in their several depositions mentioned as near as we Can discover run from the Ceader in their depositions mentioned as followes viz.t East five degrees South one perch and a halfe North fifty three degrees East sixteen perches thence north twenty four degrees East twenty Eight perches thence North thirty five degrees East fourteen perches thence South fifty five degrees East three perches thence North twenty Nine degrees East twenty perches thence North twenty two degrees East Eighteen perches thence North forty One degrees East Eighteen perches thence North Eighteen degrees East eighteen perches thence North Eight degrees West forty perches thence North twenty five degrees east fifty perches thence North one degree East thirty two perches thence North thirty three degrees West ten perches thence North forty Nine degrees West Eighteen perches thence North Seventy Six degrees West three perches & halfe Thomas Gillis (seal) Peter Sirman Senr (seal)
county aforesaid Containing Eight hundred acres Called Piney point We therefore required you or any three or two of you at some time & place as to you or any three or two of you shall seem Convenient you meet on the aforesaid Land Called Piney point (you first having taken your Oath on the holy Evangelist of Almighty God according to act of assembly in such Case made and provided) and there Cause to Come before you or any three or two of you all Such evidences as shall be to you or any three or two of you nominated by the said Complainant (or defendant if any) and that you Examine them upon their Corporall Oath to be by you or any three or two of you administred on the holy Evangelist of Almighty God in the presence of the said Complaniant (or defend.t if any) touching the truth or remembrance of their knowledge or any thing that may relate to the Cause afd and that reduceing the severall depositions into writing you said the same ^together^ with this Our Commission under you or any three or two two of your hands to us in Our County Court of Somerset with all Convenient Speed Wittness William Planner Gentleman One of Our Justices of County Court of Somerset this seventeenth day of June in the sixteenth year of Our Dominion &c to the foregoeing Commission it was thereunto anexed as followeth vizt Somerset County ss Depositions of Wittnesses taken upon the Land Called Piney Point in the County afd the 8.th day of July anno Dom One thousand seven hundred and thirty before us the Subscribers Commissioners appointed by the worshipfull the Justices of Somerset County Court to Examine evidences Wittnesses Concerning the bounds of the Land afd as followes vizt Robert |
