a Certain Alexander Adams of the County aforesaid Gent.m in relation ^to the^ bounds of part of a tract of Land Lying in the County aforesaid Called Smiths adventure We therefore require you or any three or two of you at some time and place as to you or any three or two of you shall Seem Convenient you meet on the afd Land Called Smiths Adventure [you first having taken your Oath on the holy Evangelist of almighty God according to act of assembly in Such Case made and provided) and there Cause to Come before you or any three or two of you all Such Evidences as shall be to you or any three or two of you nominated by the said Complanant (or defendant if any) and that you examine them upon their Corporall Oaths to be by you or any three or two of you administred on the holy Evangelist of almighty God in the presence of the said Complainant (or defend.t if any) touching the truth or Remembrances of their Knowledge or any thing that may Relate to the Cause aforesaid and that reduceing the severall depositions into writing you send the same together with this Our Commission under your or any three or two of your hands to us to Our County Court of Somerset with all Convenient speed Wittness Samuel Hopkins Gent.m Cheife Justices of Our Said Court the Eighteenth day of March in the fourteenth Year of Our Dominion &c On the Back side of the foregoeing Commission it was thus Endorsed viz.t The execution of this Commission appears by the Severall depositions hereunto annexed somerset ss Depositions of Wittnesses taken upon a tract of Land Called Smiths Adventure in Sumerset County upon the twelfth day of June anno Dom One thousand seven hundred and twenty Nine before us Thomas Gillis and Peter Sirman in pursuance of a Commission from Somerset County Court bearing date the eighteenth day of march 1723 directed unto Levin Gale Benj.a Cottman and us the said Thomas Gillis and Peter Sirman we the said Thomas Gillis and Peter Sirman having first duly taken the Oath and Given the Notice by the act of assembly in such Case made directed Isaac Noble of Somerset County planter aged about forty Nine Years being Sworn upon the holy Evangelist of Almighty God deposeth and Saith That William Breretons fence in the Years Seventeen hundred and Eighteen and seventeen hundred and ninteen which parsed his plantation that he dwelt upon from John Waltoms which the deponant verily believes was the fence mentioned and intended in a deed made to the reverend M.r Alexander Adams by the said W.m Brereton as the deponant hath been Informed dated on or about the Sixth day of March anno Dom One thousand seven hundred and 18/19 begun at the root of A Stooping Ceeder (close by the Eastermost side of passandick Creek) which is about twelve yards to the north westward of a hicory marked with twelve Notches and that the said fence run from thence into the woods a little to the northward of a line of trees marked with four Notches by the deponant and John Thompson the said deponant further deposeth and Saith that he hath forty five Years by past been a near Neighbour to the afd William Brereton and well acquainted with the said Breretons plantation the said deponant further deposeth and Saith that the Line of trees before herein Mentioned is marked as near to where William Breretons fence stood as the deponant and the aforesaid Thompson could marke it and keep to the Eastward of it and further saith not Sworn to before us Thomas Gillis & Peter Sirman Jno |
