1731 169 whereupon the Said John Murray by Levin Gale his attorney present here in Court prays that upon Giving Security according to act of assembly in Such Case made and provided that the afd Sum of five thousand one hundred and thirty Six pounds of tobacco (of the value of twenty One pounds Eight Shillings Curr money) so as aforesaid attached as of the Rights and Creditts of the afd Thomas Enchmarsh and Comp.a may be Condemned in the hands of the afd Philip Covington towards Satisfying unto the Said John Murray his Damages and Costs Expended &c whereupon the said Philip Covington altho' so before warned at the Same day being Solemnly Called Cometh not but makes default &c Thereupon Levin Gale Esq.r present herein Court undertakes for the Said John Murray that in Case the Said Thomas Enchmarsh and Company shall at any time within a year and a day appear and made or any part of the said John Murrays Claime against ^them^ appear to be satisfied or otherwise to have been undue before the Laying of this attachment that then the Said John Murray shall make Restitution unto him ^them^ the Said Thomas Enchmarsh and Company of all Such part thereof as Shall be made appear to be undue &c or that he ye said Levin Gale will do it for him &c Therefore it is Considered by the Court here that the aforesaid Sum of five thousand one hundred and thirty Six pounds of tobacco of the value of twenty one pounds Eight Shillings Curr.t money of maryland so as afd attached be Condemned in the hands of the Said Philip Covington as of the Rights and Creditts of the Said Thomas Enchmarsh and Company towards Satisfying unto the said John Murray his damages and Costs already Expended as also al Costs accrewing upon the writt of attachment aforesaid and that the aforesaid Jno Murray have thereof Execution against the said Philip Covington according to act of assembly &c
march then next to answer unto John Rider of a plea that he Render unto him the full and Just Sum of Six pounds Currant money of Maryland which to him he Oweth and from him he unjustly detaineth &c & that thereof the should fail &c And the Said John Rider by William Beckingham his attorney decleared against the aforesaid Thomas Baker in the plea aforesaid as followeth vizt Somerset County ss Thomas Baker late of Somerset County planter Otherwise Called Thomas Baker was Sumoned to answer unto John Rider of a plea that he Render unto him the full & Just Sum of Six pounds Currant which to him he Oweth & unjustly detaineth &c And whereupon the Same John by ^Wm Beckingham^ his attorney saith that whereas the afd Thomas the t^w^enty third day of November anno Domini one thousand Seven hundred and twenty Eight at Somerset County within the Jur of this Court by his Certain Writing Obligatory Granted himself to be held and firmly bound unto the aforesd John in the afd Six pounds Currant to be paid the Said John on the twenty Seventh day of the Same ^november^ then next ensueing yet the aforesd Thomas altho' often thereto Required the afd Six pounds unto the Same John hath not rendered but the Said Thomas the same to render hath denyed and still doth deny and Unjustly Detain whereof the same John Says he is worse and hath damage to the Value of Six pounds and thereof he |
