1731 170 he bring this Suit &c And the Said John brings hereinto Court the Writing obligatory afd w.ch &c Beckingham P Qur pledges J Doe R Roe A Copy of the foregoeing declaration was made and Sent to be Served with the writt afd on the aforesaid Thomas Baker eight days before the day of the Return of the writt same writt &c Att which Said third tuesday of march to witt the twenty first day of the Same month Anno Dom one thousand Seven hundred and thirty One being the day of the Return of the Same Writt Cometh the Said John Rider by his attorney aforesaid and the Sher of the County aforesaid to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words vizt Cepi Corpus declaration delivered in time P Joshua Caldwell sher Whereupon the said Thomas Baker at the prayer of the aforesaid John Rider by his attorney aforesaid is adjudged to Give Speciall Bail to the action aforesaid thereupon a Certain Levin Gale Esq.r of Somerset County present here in Court in his proper person undertakes for the Said Thomas Baker that if in Case the Said John Rider shall Recover Judgm.t in the plea aforesaid against the Said Thomas Baker or that the Said Thomas Baker shall be therein Convict that then he the Said Thomas Baker Shall pay the Condemnation of the Court thereupon or Render his body to the Custody of ye Sher of the County aforesaid in Satisfaction thereof or that he ye Said Levin Gale will do ye same for him &c And the Said Thomas Baker by Levin Gale his attorney cometh and defendeth the force and Injury when &c and Says that he Cannot Gainsay the action aforesaid of the aforesaid John Rider nor but that the writing Obligatory aforesaid is the deed of the Same Thomas nor but that he owes the Same John the aforesaid Six pounds of Currant money in manner and form as the afd John above against him declared &c Therefore it is Considered that the afd John Rider Recover against the Same Thomas Baker his debt afd and his damages by Occasion of ye detaining of the same debt 293 to Two hundred & Ninty three pounds of tobacco to the Same John of his assent by the Court here adjudged and ye afd Thomas in Mercy &c
tuesday of march then next to answer unto Richard Gildart esquire of a plea of trespass upon ye Case &c and that thereof he Should not fail &c And the Said Richard Gildart by W.m Beckingham his attorney declared against the Said Charles in the plea aforesaid as followeth vizt Somerset County ss Charles Young Late of Somerset County planter was attached to answer unto Richard |
