present here in Court in his Proper person and whereupon the Same NIcholas at the prayer of the afd John
by his attorney afd is Committed into the Custody of the afd Sher thereto remain untill the afd John of the
debt and damages afd should be fully Satisfied the said Sher to witt Joshua Caldwell Gent present here
in Court took Charge of ye said Nicholas accordingly &c

 memorand.m the plft John Murray by Levin Gale his attorney Sued out his Lordships writt
of attachment against the deft the tenor whereof followeth in these words viz.t
Somerset ss    Charles absolute Lord and proprietary of the provinces of Maryland
and avalon Lord Baron of Baltemore &c   To the Sher of Somerset County Greeting we Comand
you that you attach any the Goods Chattells Rights or Creditts of Tomas Enchmarsh and
Company Late of Somerset County Merch.ts if they Should be found in your bailywick
to the Value of twenty one pounds Eight Shillings Currant money of maryland and
one thousand pounds of Tobacco and when you have the Same Attached or any part
thereof the Same in your Custody safe keep so that you have the Same before our
Justices of our County Court of Somerset to be held at Dividing Creek the third tuesday
of March Next then and there to be Condemned According to act of assembly to and
to and for the Use of a Certain John Murray unless the Said Thomas Enchmarsh
and Company by themselves or their attorneys shall appear and answere unto
the Said John Murray in a plea of trespass upon the Case &c    According to
Law and that by good and Lawfull men of your bailywick you make known
unto the Person or persons in whose hands you make the ^same^ attachment that he
she or they be and appear before our Justices of our County Court to be held ^as^ afd to shew
Cause if any he she or they have why the Same good Chattells Right or Creditts so
attached in his her or their hands ought not to be Condemned and Execution thereof
had and made according to act of assembly in Such Case made and provided
if to him her or them it shall seem meet and how you shall Execute this writt that
you make know unto our said Justices at the day and year aforesd and have
you then and there this writt wittness Sam.l Hopkins Gent Chief Justices of our
Said Court the twenty day of Novemb.r in the Seventeenth year of our Dominion &c
Ann Dom one thousand Seven hundred and thirty one

      Att which said third tuesday of march to witt the twenty first day of march anno Dom One thousand
Seven hundred and thirty One being the day of the Return of the Said Writt Cometh the said John Murray by his attorney
afd and the Sher of Somerset County to whom the foregoing writt was directed   Likewise Cometh and makes Return of
the Same Writt thereof Endorsed in these words following vizt   By Vertue of the within Writt to me directed to
the Justices within Mentioned  I Certifie that upon the tenth day of february One thousand Seven hundred and thirty
One I did attach in the hands of Philip Covington as the Goods and Chattells Rights and Creditts of the within
named Thomas Enchmarsh and Company five thousand One hundred and thirty Six pounds of tobacco of the
Value of twenty One pounds Eight Shillings Curr.t money and further I Certifie that I did make known
unto the Said Philip Covington that he be and appear at the time and place within Contained to Shew &c
as by the within preceipt I am Commanded so answers Joshua Caldwell sher
