168 in manner and form as the aforesaid George above against him Complained and as to the damages of the Same George by him by Occasion of the premisses in that part sustained the Same William Saith and Confesseth that the aforesaid George has Sustained damages by Occasion of the premisses beyound his Costs and Charges by him about his Suit in that part apposed to Eleven pounds Sixteen Shillings and Six pence Currant money of Maryland and no more and because the aforesaid George deny's not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid It is Considered that the aforesaid George Eskridge Recover against the aforesaid William Wye his damages aforesaid to the afd Eleven pounds Sixteen Shillings and Six pence Curr.t money of Maryland by the Same William in form aforesaid Confessed as also Two 207 hundred & Seven pounds of tobacco for his Costs and Charges aforesaid to the Same George at at his Request by the Court here and Consent of the parties aforesaid adjudged which Certain damages in the whole do amount to elven pounds Sixteen Shillings and Six pence Curr money and pounds of tob.o and the aforesaid W.m in Mercy &c
Nicholas the Seventh day of October anno Dom one thousand Seven hundred and thirty at Somerset County within the Jur of this Court by his Certain bill or writing obligatory Granted himselfe to be Indebted unto the afd John Rider In the aforesd sum of Nine pounds Eighteen Shillings and ten pence Currant money ^to be paid^ the Said John when afterwards he Should be thereunto requested yet the afd Nicholas Altho often thereto required the afd Nine pounds Eighteen Shillings and ten pence unto the Same John hath not Rendred but the Said Nicholas the Same to render hath denyed and Still doth deny and unjustly detain whereby the Same John says he is worse and hath damage to the Value of ten pounds Like money and thereof he brings this Suit &c and the Said John brings hereinto Court the witing obligatory afd w.ch &c Levin Gale P Qur Pledges Jn Doe R Roe And the aforesaid Nicholas Buckley in his proper person Cometh and defendeth the force and Injury when &c and thereupon the Said Nicholas at the prayer of the aforesaid John is adjudged to Give Speciall Bail to the action afd but for want thereof the Said Nicholas is Committed into the Custody of the Sher of Somerset County thereto Remain &c the said Sherr to witt Joshua Caldwell Gent present herein Court took Charge of ye said Nicholas accordingly &c And afterwards the Said Nicholas in Custody as afd present herein Court Says that he Cannot Gainsay the action aforesaid of the aforesaid John nor but that the writing afd is his deed nor but that he Owes the Same John the aforesaid Nine pounds eighteen Shillings and ten pence Curr money in manner and form as the aforesaid John above against him hath declared Therefore it is Considered that the aforesaid John Rider Recover against the afd Nicholas Buckley his debt aforesaid and his damages by Occasion of ye detaining of that Same debt to two hundred & One Eighty One pounds of tobacco to ye Same John of his assent by the Court here adjudged and the afd Nicholas in mercy &c Afterwards to witt the twenty first day of march one thousand Seven hundred and thirty One the Same Nicholas present |
