    Costs and Charges by him about his Suit in that part apposed to thirty Eight pounds Eighteen Shillings &
    three pence Sterling money and no more and because the aforesaid George deny's not this but the same
    allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his
Costs and Charged afd to him adjudged &c

                         Therefore by Consent of the parties aforesaid   It is Considered that the afd George Eskridge
Recover against the aforesaid William Wye his damages aforesaid to the aforesaid thirty Eight pounds Eighteen
Shillings and Six ^three^ pence Sterling money by the Same William in form afd Confessed as also three hundred & forty
340                                             pounds of tobacco for his Costs and Charges aforesaid to the Same George at his
Request by the Court here and Consent of the parties afd adjudged which Certain damages in the whole do amount
to thirty Eight pounds Eight^een^ Shillings and three pence Ster and
pounds of tobacco and ye afd W.m in mercy &c

                     William Wye Late of Somerset County Clerk was attached to answer
unto George Eskridge of a plea of trespass upon the Case &c
          And whereupon the Same George by Levin Gale his attorney Complaines that whereas the aforesaid W.m
the tenth day of September ann Dom one thousand Seven hundred and thirty one at Somrset
County within the Jur of this Court was Indebted unto the Said George in the Sum of Eleven
pounds Sixteen Shillings and Six pence Currant money of Maryland as by account hereunto
Anexed may appear and so thereof being Indebted the Said W.m in Consideration thereof
afterwards to witt the same day and year aforesd at the County aforesd and within the aforesd
Jur upon himself assumed and to the Said George then and there faithfully did promissed that
when afterwards he should be thereunto Requested he the afd Sum of Eleven pounds
Sixteen Shillings and Six pence Currant money of maryland to the Same George would
well and faithfully Content and pay   Nevertheless the Said William his promise and
assumption afd in forme afd made Little Regarding but Plotting and fraudulently Intending
him the same George in that part Craftilly and Subtilly to deceive and Defraud the Said Will.m
the afd Sum of Eleven pounds Sixteen Shillings and six pence Currant money  Nor any part thereof
to the Same George hath paid or him for it in any wise Contented altho the Same Will.m
afterwards to witt the Same day and Year afd at the County afd and within the ^afd^ Jur was thereto
Requested by the Same George but the said W.m the same to do hath altogether refused and
Still doth refuse and Deny  Whereby the Same George says he is worse and hath Damage to the
value of twenty three pounds thirteen Shillings Like money and thereof he brings Suit &c
