165 Speed Wittness William Planner Gent One of our Justices of our said Court the twentyeth day of November in the Sixteenth Year of our Dominion &c Ann Dom one thousand Seven hundred and thirty Afterwards to witt this twenty first day of march Ann Dom one thousand Seven hundred and thirty one Came here into Court George Dashiel and Thom.s Gillis two of the Gent Mentioned in the above Commission and made Returne thereof with the Severall Depositions thereunto Annexed as foloweth (memorand.m the Endorsm.t of the Com.rn should have been rendered here but was omitted and is recorded at the foot of the following depositions Somerset County ss The depositions of Wittnesses taken at the plantation of George Godart in the County aforesd the Ninth day of may ann Dom 1731 by Vertue of a Commission to us directed out of his Lordships Court of Somerset County bearing date the 20.th day of November Anno Dom 1731 for the Examining Such Evidences as Shall be produced to us touching the bounds of a tract of Land Called Toneys Vineyard Vizt Isaac Noble aged fifty years of there abouts being Sworn on the holy Evangelist of almighty God in relation to the Upper Bounder of the Land Called Tonies Vineyard belonging to Benj.a Mitchell taken at the request of his Gardian W.m Sillavin which did belong to John rine saith that he was in Company with Steven Horsey and Coll W.m Whittington Surveyer about thirty years agoe at the takin up the Same Land he Either marked or help to mark it or at least saw it marked a Ceader tree about Seven ye yards below George Godarts Landing by a Valee Next to the Landing for the first bounder of the Said Land this part is now Called in the alenation roys Purchas and further Saith not the Said tree is Down but the marks to be seen Peter Surman aged Sixty years or there abouts Deposeth and Saith that he was in Company at the Same time with Isaac Noble at the Survey of the Land Called Tonies Vineyard and that he saw the Ceader Discribed in Isaac Nobles Deposition marked for a bounder of said Land and further Saith not Geore Dashiell Tho.s Gilliss September 14.th 1731 Then Came before me the Subscriber one of the Lord proprietarys Justices of the peace for the County of Somerset Cap.t George Dashiel and M.r Thom.s Gillis and made oath on the holy Evangelist of almighty God to Execute the within Commission according to the directions of the act of assembly in that Case made and provided according to the best of their ^skill &^ knowledge Sworn to before me Willm Stoughton
