    he was In Company with John Booth Daniel Booth and Jonathan Cooper
    Surveyer and that he Saw John Booth marke a Spannish oak where the
Deponant now Stands which is by the Marsh side oposit to M.r Leatherburys
house where Joy Hobbs now has His pasture fence and that the bounder was
then marked for a Decision Between John Booth and Daniel Booth and this
Deponant further Saith that they run a line from that tree out into the woods
and Marked a Line of trees which this deponant Showed one of the Line trees
to us it being a red oak Standing nigh the Side Line of a tract of Land belonging
to Cap.t George Dashiell and this deponant Saith that he Saw John Booth mark
the Said tree and Cap.t George Dashiell has remarked it with two Nothes on
four Sides and allows it to be a bounder by his own Consent and further saith

Somerset ss    Charles absolute Lord and proprietary of the provinces of Maryland
and avalon Lord Baron of Baltemore &c   To George Dashiell, Merrick Ellis, Thomas
          Walker and Henry Ballard all of Somerset County Gent Greeting Know Ye that we have appointed
you or any three or two of you to be Our Commissioners to Examine Evidences on behalfe of a Certain
Joy Hobbs of the County aforesaid in relation to the bounds of three tracts of Land Lying in the County
aforesaid Called abington Carneys Chance and White Oak Swamp   We therefore Require you or any
three or two of you at some time and place as to you or any three or two of you shall seem Convenient
you meet on the aforesaid Lands Called Abington, Carneys Chance and White Oak Swamp (you first
having taken your Oaths on the holy Evangelist of Almighty God according to act of assembly in
Such Case made and provided) and there Cause to come before you or any three or two of you all
such evidences as shall be to you or any three or two of you nominated by the Said Complainent
or deft (if any) and that you or any three or two of you Examine them upon their Corporall Oaths
to be by you or any three or two ^of^ you administred on the holy Evangelist of Almighty God in the
presents of the Complainent or deft (if any) touching the truth or remembrances of their knowledge
or any thing that may relate to the Cause aforesaid and that Reduceing the Several depositions into
writing you Send the Same together with this Our Commission under your or any three or two of your hands
to us to Our County Court of Somerset with all Convenient speed Wittness W.m Planner Gent One of Our
Justices of Our said Court the twentyeth day of march in the Sixteenth year of Our Dominion &c Ann Dom
One thousand Seven hundred and thirty

Afterwards here to witt this twenty first day of march one thousand Seven hundred and thirty one Came here
into Court George Dashiell and Henry Ballard two of the Gent.ns Nominated in the above Commission and
made Return thereof with the Severall depositions thereunto annexed as followeth

September the 14.th 1731   then Came before me the Subscriber One of the Lord proprietarys Justices of
the peace for the County afd   Capt George Dashiell Mr Thos Walker and Mr Henry Ballard and made
