159 March anno Dom one thousand Seven hundred and thirty one Came hereinto Court at Dividing Creek before the Justices thereof the said John Whaley in his proper person and being Instantly demanded how he would acquit himself of the Premisses aforesd as by the Information aforesd above upon him ^is^ Imposed the same John saith that he Cannot deny but that he is Guilty of the Premisses aforesd by the Information aforesd above upon him Imposed and is willing to pay his fine for the fact afd whereupon all and Singular the premisses by the Court here being seen heard and fully understood It is Considered by the Court here that the aforesaid John Whaley pay unto his Said Lordship for his fine by the Court hereupon him Imposed for and by occasion of the Premisses afd whereof in forme afd he is Convict to Six hundred pounds of Tobacco and that the said John Whaley be taken to satisfie his said Lordship of the fine aforesd whereupon it is ordered by the Court here that the aforesd John Whaley give Security for the payment of the fine aforesd and the Severall Officers fees due by occasion of the premisses afd thereupon Charles Young of Somerset County Gent undertakes for the Said John Whaley to pay the fine afd and the Severall Officers fees due as aforesd &c
here in Court acknowledged themselves to Owe to the Right honrble Charles absolute Lord and proprietary the sum of twenty pounds Sterling goo each Good and Lawfull money of England of their Severall Goods and Chattells Lands and tenements to the Use of his Said Lordship his heirs and Successors if it happen that the Said John Webb do not make his personall appearance before the Justices of his said Lordships County Court of Somerset to be held at dividing Creek the third tuesday of June next and do not answer unto his Said Lordship of and Concerning what shall be Objected against him on his Said Lordships behalf and do not stand and abide the Judgmt of the Court thereon and do not depart the Same Court without Lycence thereof and is not in the mean time of the Good behaviour to all his Said Lordships good people &c
Whereupon the said Dorman Heath acknowledged himselfe to Owe and Stand Justly Indebted unto his Said Lordship the Lord proprietary in ten pounds Sterling of his Goods and Chattells Lands and tenements to the Use of his Said Lordship ^his heirs & Successors^ to be made and Levied if it Happen that the Said Dorman Heath do not make his personall appearance before the Justices of his said Lordships County Court of Somerset to be held |
