153 and Daniel Lingoe and every of them acknowledged themselves to be Indebted unto his Said Lordship the Lord proprietary in the Sum of five pounds Sterling Each of their Severall Goods and Chattells Lands and tenements to be made and Levied to the use of his Said Lordship the Lord proprietary his heirs and successors &c In case they and Every of them do not make their personall appearance before the Justices of his said Lordships County court of Somerset to be held at dividing Creek the third tuesday of June next and then & there do not Give Such evidence as they Shall know against Thomas Duncan of and Concerning such matters as he Stands accused of and do not depart the Same court without Lycence thereof &c
hundred and thirty one with force and armes &c at Somerset County aforesaid within the Jurisdiction of this Court in and upon a Certain Patrick Burk in the peace of God ^and^ of the Right Honrble the Lord propry then and there being an assault did make and him did beat wound and Evill Entreat and other harms to the said Patrick then and did against the peace ^and^ against the good rule and Goverment of the Lord Proprietary wherefore the said Levin Gale pray the advise of the Court in the prmisses and due process of Law thereupon to be awarded &c And in manner here at this term held for Somerset County at dividing Creek this twenty first day of march One thousand Seven hundred and thirty One before the Justices ^of said County Court^ Cometh the aforesaid William Horsey according to a Certain Recognizance by him and his pledges in that part first acknowledged in his proper person and hath a hearing of the Information aforesaid who says that he is not thereof Guilty and of this he putts himselfe upon the Country and Levin Gale Esq.r his Lordships attorney & who for his said Lordship in that part followeth likewise &c thereupon Immediately cometh thereof the Jury before the afd Justices Last named here twelve &c who neither &c to Recognize &c because as well &c and the Jurors of the Same Jury by the Sherr of Somerset County ^to this^ being Impannelled who being Called Came to witt Parker Selby, John Purnall Jun.r Peter Frazer, Joshua Sturges, John Roach, Isaac Atkinson, John Brittingham Robert Mitchell, John Webb Richard Knight Thomas Collins and Angello Atkinson who is to say the truth in the premisses being duely elected tryed and Sworn upon their Oath do Say that the aforesaid William Horsey is not Guilty of the trespass and assault by the Information aforesaid above upon him Imposed &c upon this the premises being by the Court here seen heard and fully understood &c Wherefore it is Considered that the aforesaid ^Wm Horsey^ be quiet and Goe thereof without day &c whereupon it is ordered by the Court that the aforesaid William Horsey Give Security for the payment of the Severall officers their fees due by Occasion of the premisses aforesaid thereupon a Certain Nat Horsey of Somerset County Gent undertakes for to pay ye Severall Officers Fees due by occasion of the premisses afd &c |
