152 pleas and Clerk of Indictments in the Same Court and gave the same Court to understand and be informed that Johnson Hill Late of All hallows parish in Somerset County planter the first day of Aprill in the Year of our Lord God Seventeen hundred and thirty one aforesd he the Said Johnson then and there being as married man at the Place and County aforesd and within the Jur of this Court did Commit Adultery with a Certain Sarah Mackerell of the County aforesd Spinster and on the body of the Said Sarah then and there did beget a bastard Child to the high Displeasure of Almighty God and ^to^ the evil Example of all others in Such Cases offending and against the forme of the act of Assembly in such Case lately made and provided whereof the Same Leven Gale prays the advise of the Court in the premises and due process of Law thereon against the Said Johnson Hill to Issue &c Now hereat to witt this Sixth day of October One thousand Seven hundred and thirty One being the Same term before his Lordships Justices at dividing Creek for Somerset County Cometh the aforesaid Johnson Hill in his proper person and had a hearing of the Information afd and says that he is not Gilty thereof and of this he puts himselfe upon the Country and Levin Gale who for his said Lordship in this behalfe prosecutes Likewise &c whereupon the said Johnson Hill prays Leave thereof to Imparle here untill the next Court and he hath it and the Same day is Given to the aforesaid Levin Gale who &c Att which said next Court to with the Sixteenth day of November One thousand seven hundred and thirty One Came againe as well the aforesaid Levin Gale who &c as the aforesaid Johnson Hill in his proper person and whereupon the Same Johnson Hill prayed further Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the afd Levin Gale who for his Said Lordship in that part follows here also &c Att which said next Court to witt the twenty first day of march one thousand seven hundred and thirty One Came againe as well the Said Levin Gale who &c as the aforesaid Johnson Hill in proper person and whereupon the Said Johnson Hill Relinquisheth his veryfication aforesaid by him above pretended and Submitts with a protestation of his Innocency and putts himselfe upon the favour of ye Court &c whereupon all & Singular the premisses by the Court here being seen heard and fully under Stood It is Considered by the Court here that the aforesaid Johnson Hill pay to his said Lord^ship^ for his fine by the Court here upon him Imposed for and by Occasion of the premisses whereof in form aforesaid he is Convict three pounds Curr.t money (to the Use of the County aforesaid) and that the Said Johnson Hill be taken to Satisfie his said Lordship of the fine aforesaid ^whereupon it is^ ordered by the Court that the Said Johnson Hill Give Security to pay the fine aforesaid and the Severall Officers their fees due by Occasion of the premisses aforesaid thereupon a Certain John Purnall sen.r of Somerset County Gent present herein Court undertakes for the said Johnson Hill to pay the afd fine and all the Officers their fees due by Occasion of the premisses aforesaid Likewise the Said Johnson Hill is ordered to Give Security for to save harmless the Justices of Somerset County from all troubles Costs Charges & Incumbrances that might happen for or by reason of the birth maintainance nourishment and bringing of a bastard Child Lately begott of |
