150 afd then being at the same day before his Lordships Justices at the County Court of somrset at Dividing Creek Returned that by Vertue of the Preceipt afd to him thereof directed to had taken the bodys of the aforesd Esther Jenkins whose body he had there Ready &c Whereupon the said Esther Jenkins in her proper person apears and is thereupon Immediately asked after what manner she would acquit herselfe of the Premises in the presentment afd above upon her Imposed the same Esther says that she can not Deny but that she is Gilty of the Premisses aforesd in the presentment aforesd specified above upon her Imposed &c & makes oath that Benja Fasque is the father of the Child she stands presented for &c Whereupon all and Singular the Premises by the Court here seen heard and fully understood and for as much as the Said Esther Jenckins has nothing to pay her fine for the fact afd Wherefore it is Considered that the aforesaid Esther Jenckins be whipt at the publick whiping post with twenty lashes on the bare back well Laid on untill the blood appear and as to the Corporall punishment afd Command is Given to the Sher of somerset County that he do thereof Immediate execution by whiping of the Said Esther Jenckins at the publick whiping post well Laid with twenty Lashes on the bear back well Laid on untill the blood appear and that she be taken &c and afterwards in the Same Court Came the Said Sher and made return of th to the Court here that he had done the Execution of the Judgm.t aforesaid as to the Corporall punishment afd he was Commanded Whereupon the Said Esther Jenckens is ordered by the Court to Give recognizance in five pounds Ster for her appearance from day to day this Court to Give evidence to the Grant Jury against the said Benjamin Fasque Thereupon the said Esther Jenckens acknowledged herselfe to be Indebted unto his Lordship the Lord proprietary under the Sum of five pounds ster to be made of her Goods and Chattells Lands and tenements to the Use of his Said Lordship his heirs and Successors if it happen She fail in the above order Likewise it is ordered by the Court here that the aforesaid Esther Jenckins Give Security to pay the Severall Officers their fees due by Occasion of the premises but for want thereof the said Esther Jenckins is Committed into the Custody of the Sher of somerset County thereto remain &c
take the said Susannah Carter Late of Somerset Parish in somerset County Spinster if she sould be found in his bailywick and her should Safe keep so he might have her body before the Justices of his Lordships County Court of Somerset to be held at Dividing Creek the third tuesday of march Next to answer his said Lordship of the presentment aforesd and that thereof he should not fail &c Att which said third tuesday of March to witt the twenty first day of the same month one thousand seven hundred and thirty one the Sher of the County aforesd then being at the same day before is Lordships Justices at the County Court of |
