this Court was Indebted unto the said William in twelve hundred and forty two pounds of tobacco and seven pounds twelve shillings and four pence Currant mony of Maryland as by an account hereunto annexed may in Court appear and being so thereof Indebted the said Charles in Consideration thereof the day and year aforesaid at the County aforesaid within the Jurisdiction aforesaid upon himselfe did assume upon himselfe and to the said William then and there faithfully did promise that he the aforesaid Charles the aforesaid twelve hundred and forty two pounds of tobacco and Seven pounds twelve shillings and four pence when he should be thereunto requested he would well and faithfully pay and Content nevertheless the said Charles his promise and assumption aforesaid in form aforesaid made nothing regarding but plotting and fraudulently Intending the said William in that part Craftilly and Subtilly to defraud and deceive the said twelve hundred and forty two pounds of tobacco and Seven pounds twelve shillings and four pence to the said William on the aforesaid tenth day of aprill in the Year afd at the County aforesaid within the Jurisdiction aforesaid by the aforesaid William he was thereunto Requested hath not paid or to him for the Same in any Sort Contented but the Same to him to pay or in any sort to Content hath refused and still doth refuse and deny whereupon he sayth that he is worse and hath damage to the value of two thousand four hundred and Eighty pounds of tobacco and fifteen pounds four shillings and Eight pence Currant money and whereupon he brings Suit &.c F Allen P Quer Pledges deps Jno Do R Roe
and prays Leave thereof to Imparle hereunto untilll the next Court and he hath it and the Same day is Given to the aforesaid plft here also &c Att which said next Court here to witt the Eighteenth day of August anno Dom one thousand seven hundred and thirty Came again as well the afd William Ennalls by his attorney aforesaid as the afd Charles Croson in his proper person and whereupon the said Charles says that he Cannot Gainsay the action afd of the aforesaid William nor but that he did assume upon himselfe in manner and form as the aforesaid ^William^ Above against him hath Complained and as to the damage of the Same William by him by Occasion of the premisses in that part Sustained the Same Charles says and Confesseth that the aforesaid ^William^ has Sustained damages by Occasion of the premisses further than his Cost sand Charges by him about his Suit in that part apposed to twelve hundred and forty two pounds of tobacco and seven pounds twelve shillings and four pence Currant Mony and not more and because the afd William denys not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges afd to him adjudged &.c Therefore by Consent of the partyes afd it is Considered that the aforesaid William Ennalls Recover ag.t the |
